It may depend on the State but she wouldn't need to press charges with the police AG seeing the video in many States.

She won’t show for court to testify and he’ll get off. She just stayed in that room with him and took it. She’s in full Stockholm Syndrome mode. Sad. That mfer needs his arse whipped by someone who can do it.

What's interesting is the cameras rolling inside the home.. something like this has happened before. I wonder if she set these up to catch it on video.

Charges don’t have to be pressed by her in a domestic assault case. His arse is up the creek, bank on it!

People file for these all the time and decide not to prosecute them or don't even show up to court. She's also going to have a RO against him as conditions of his bond. That's generally automatic in DV cases. But if she tells the DA she doesn't want to go forward with it, they generally dismiss the case and those conditions of release go away with it.

They don't have to be, but DA's don't typically press DV cases without a cooperating victim unless the injuries are severe.

Doesn’t matter. Once you’ve been charged with domestic assault, whether you’re prosecuted or not is entirely up to the DA. She could swear it was all her fault, the DA could still prosecute.

It also could have been something as simple as a baby monitor that recorded it.

This may be true in a he said/she said case. However, with this video you can bet the house his arse is in big trouble.

Her filing for a RO and him being prosecuted criminally are two completely different cases. SO in that context with respect to the RO, it does matter. And yes, the DA CAN prosecute a DV without a cooperating victim, but they typically don't.

They'd still need someone to authenticate the video. If she refuses to cooperate, it creates a much larger burden for the state to have an expert properly authenticate it. The state could certainly subpoena her to testify, against her wishes, to the accuracy of the video and hold her in contempt, in theory, if she still refuses. But if she refuses, it becomes a more daunting issue for the state to lay a proper foundation for the video to get in and would require experts to do it. I don't know if he's being charged with a misdemeanor or felony, but the chances are a lot smaller the state invests that much time, effort, and money on a misdemeanor.
