People who drink to excess and blackout are still functional to a degree (other than their inebriated behavior) during the period of the blackout. They just don't remember anything from it or at least very little when they sober up.
He could likely tell she was drunk. But, impossible to know at the time if she was black out drunk.
I assume they meant passed out or incoherently, sloppy drunk on the verge of passing out... which would also make consent and/or asking for the bathroom not manageable
