I may be wrong, but outside of perhaps a signing bonus, I don't think an NFL player has to pay back any contracted amount already paid if they leave the contract early. Something like that would probably die a quick death in a courtroom any way.
That said... More companies forcing employees to pay 'back' training fees if they quit too soon after starting the job. I think that those kind of practices will eventually crash headlong into an artificial restraint of trade wall, and perhaps even constitutional concerns. But we'll see. The NCAA's death may pave the way for that recent practice to end.

Seems like the issue is selective enforcement. The NCAA could just remove the waiver process altogether and keep the transfer rules intact

I can't imagine any positive outcome for college football coming from this possibility. Endless transfers with being immediately eligible to play would be final nail in the college football coffin.
Y'all think NIL tampering is bad now, imagine a world where you can go grab a player from any team out there with the promise of NIL money and have them play immediately. There's a G5 quarterback out there lighting it up and your P5 starter just went down with an injury? Just go grab that G5 guy and sign him to a $250k NIL deal, he starts for your team next week.
A P5 team needs to overhaul it's Oline after two games because they look like crap? Just go pick up every promising lineman from the Sunbelt and MAC you can sign to a $50k NIL deal and have them in the rotation next week
Hopefully cooler heads will prevail here and realize this would be the absolute end of any semblance of college football, baseball, or basketball that fans have come to know and love. Might as well be a semi-pro farm league at that point

NIL contracts will have buyout clauses. You won't see many leaving in season.
There will need to be stiff punishments for tampering with any player under contract, as well.
