This isn’t great because the argument made in courts can be well, they had a chance to play NCAA ball again. Not just in the SEC. I could see some component of well SEC schools offered me more which could help, but overall if the goal is CFB again. They were given the opportunity.
This is exactly why suits against the SEC or other conferences are meritless. The NCAA is vulnerable to antitrust cases as a monopoly. The conferences are not, unless you can prove collusion, and having a conference or two with different rules undercuts any monopoly argument. So, let some irrelevant conferences like the Big East have different rules; it serves the greater good.

Not quite. Certainly monopoly is one plausible weakness. But there plenty existing commerce, anti-trust, and labor laws that are at the forefront of all of the winning lawsuits. And even more applicably, these are almost all state and federal funded public institutions, meaning they far more sensitive to Constitutional concerns.

There is the argument that since a conference is smaller, maybe it can slip through. But these are interstate conferences - again composed of mostly public institutions. The laws are decidedly not on their side on this issue. It will be very difficult.
