One surefire way to beat a DUI is to not drink and drive.

I was once charged with DUI but it got thrown out in court b/c my BAC was 0.041 and there were no drugs in my system.

If you know you're drunk, refuse to blow. But don't admit to drinking, or say you haven't been drinking. Just say "if you gotta take me to jail, take me to jail". It takes 15 min to get you to station, another 30-40 min to prepare the machine that you blow in. Right when they get it ready, tell them you prefer a blood test. They have to put you back in the car, drive to the hospital, and go through the process to get blood work done. You're sober by this time

I'm really just hoping people aren't stupid enough to try this. In my opinion, the newspaper shouldn't have published the whole thing to let people know. I get that he's a former gator, but really? They are setting a bad precedent here.

Please I drive drunk every Thursday through Saturday night I'm a pro. But I live 30 min from any town and just take backroads

I'm guessing you've never actually done this. You will still get a DUI even if you do all that. When you sign your driver's license you agree to blow. If you refuse they'll just give you a field sobriety test and arrest you for refusal to blow.

I did almost this exact thing one night, except right when the nurse came in with the needle, I told them I was scared of needles and changed my mind. I tried to buy as much time as I could. When we got back to booking, they refused me the breathalyzer! They were not happy about driving me around. Took it to court and was found not guilty by a jury. Was I drunk, probably but I wasn't going to give them anything to fight me with.

We just ask people for a breath test. If they refuse, we suspend their driver's license on the spot, then fax a search warrant application to the judge downtown. Takes 15 minutes if you know what you're doing. Take them to the hospital 5 minutes away. It's not really a big deal.

State law in GA is blow or automatic 6 mo license suspension. Just fyi.

It all depends on the cop that pulled you over, the municipality, and the level of corruption within the department. Some departments have their own rules, others have inner circles within the police force. The law broke the law in my case, but I lucked out in the end. Others, I'm sure, aren't as fortunate.

Correct answer

Even tho I have enough cop friends and judge friends to probably beat any arrest as a courtesy to them I never drink and drive. Keeps everybody safer and does not tax long term friendships. In the old days the cops would actually be your cab ride home if you asked them to without them having to pull you over. I miss the old days.

Take the keys out of the ignition and throw them on the dashboard before the cop gets to your door.

Has worked for me in the past.

Sign your drivers license? You don't have to do that..not in MS. And they will arrest you for not blowing, but they still have to get you on record at the station to charge with a DUI. If you do what I say, by the time they draw blood, your BAC will likely be below the legal limit, and they can't charge you.

This is in MS, and yes it does work.

In Georgia if you refuse to blow and fail the field sobriety it's an automatic year loss of license. Also blood can be taken at the station.

In MS, if you don't blow your license is automatically suspended for a year (or so MS cops have told me) simply for refusing to blow.
