The first reaction of the guys on DawgNation was that he would not return, that he had played his last football game for UGA.

My gut says he'll avoid arrest and be on the field no earlier than the SECCG. This would give time for the DA and SO to do their work, a decision to be made, and time enough for the accusation to fade a bit in the mind of the public.

That said, there's a non-zero chance that UGA will want to avoid having him on campus and on the football field even if he's not charged. The brand is bigger than any one player.

If that turns out to be true then “innocent until proven guilty” means what exactly here?

A he said-she said isn't like a lot of other crimes. No matter which way the DA goes, there will be people questioning his decision and they'll be entirely justified in doing so. Only two people on Earth know what happened that night, the rest of us are left to speculate. With those inevitable questions lingering, UGA would have to tread very carefully from a PR standpoint.

Best to assume never

UGA wont risk allowing him back unless totally exonerated. And there’s not many scenarios where that’s likely going to happen in under 2 months is there?

Not necessarily. Public Relations for a major NCAA program is, ya know, kind of a big deal. They don't take unnecessary risks, nor would they put their brand on the line for a football player, no matter if he's charged or not.

If AA has conclusively exculpatory evidence, he could be back. If this remains a "he said, she said", even if uncharged, he likely won't.

Its not he said she said, its what the Prosecution can prove in court. Without an arrest already, i would say that they already know it would be uphill even without one of the 4-5 best criminal defense attorneys in the US.

Duke LaCrosse and AJ Johnson. Years later, both acquitted. If the DA charges, his life will be in limbo for a long time.

It’s been almost 9 days and he still hasn’t even been arrested and charged. So appears to me there’s not even enough for probable cause for that, so I seriously doubt the DA believes he has a winnable case.

Which then makes me believe all we’re waiting on is the EOO to finish its investigation. And again, if the police can’t even find a smidgen of probable cause, then the EOO sure isn’t gonna find anything either.

So my gut is telling me that if no arrest ever happens, he might be back by the Charleston game.

If law enforcement can’t prove anything and has no case, UGA has a responsibility to restore this kid and not delay or chance ruining his career. If he’s not convicted, he’s innocent, period.

I doubt he returns unless the DA makes a statement that no charges will be filed against him. That will likely take at least 3 or more weeks.

…and what the school does. The school has a much lower evidence burden.

His personal priority will be to get cleared prior to draft and of course avoid jail time.

His attorney knows by now what they are up against.

I wouldn’t be surprised at all if he is done..guilty or not.

Can’t make a gut feel bc there’s simply not enough info known to us about the case. Dying to hear his side from beginning to end. Who is this woman to him?

Until all the facts come out, the only sure thing is that UGA doesn’t want any title IX trouble, so it’ll be later than sooner.

Also I heard one of the beat writers interviewed (I forgot which one) who stated "There's not much above Kirby's head but this is above Kirby's head" saying he is still on scholarship, can attend classes and practice but not compete until its dropped.
