I used to drive drunk a LOT. Can't say anything to either parties about this. There but for the Grace of God, there go I.
I feel terrible for the little boy and his family. The kid who did it can serve his sentence, make restitution and turn his life around. I sincerely hope he does it.

Feel bad for all involved. Probably best not to comment until more is known about what happened.

More details continue to emerge about Saturday’s car accident that killed four-year-old Marco Lee Shemwell outside of Kroger Field. University of Kentucky President Eli Capilouto sent out a campus-wide email this afternoon announcing the school has suspended Jacob Heil, the 18-year-old student that struck Shemwell, and Alpha Tau Omega (ATO), the fraternity he was pledging.
As reported earlier, the police report says Heil blew a .051 BAC at the scene around 2 p.m. He claimed he had two beers around 9:30 a.m. at a tailgate party leading up to the game. According to a letter from UK to ATO obtained by the Herald-Leader, that party was an unregistered tailgate held by ATO where alcohol was served to minors and every pledge was forced to serve alcohol to other people, a hazing violation. Fraternities are not allowed to serve alcohol on campus unless it’s a registered event.

Dr. Cap does not fool around. The ATO house is going to get suspended quick.
ETA: He already did...he holds the Greek System on campus to high standards and will punish if they screw up. He is a great leader for the university.

.051 is nothing. I am wondering if the kid was not where he was supposed to be. Were any other pedestrians hit?

Yeah this really shouldn't be portrayed as a drunk driving incident. The driver may still be at fault but he didn't drive drunk - not in any real sense.

State of Kentucky has a zero tolerance law for minors under age of 21....you drink and drive, you’re in trouble like this kid is. Does not matter what he blew, he got behind the wheel after consuming.

I don't care what the idiotic law says although I acknowledge he'll be charged by those laws. The fact is a .051 is nowhere close to drunk. This law is going to be used to railroad a teenager who probably already bore fault for the accident due to simply not paying attention but he's not the demon that police, prosecutors, the media and peanut gallery will portray him as and already have portrayed him as.

Now if it had been the E house, they might have gotten a week of double secret probation.
For those unaware, E house at UK was the date rape house back in the day and rolled one of their pledges in toilet paper and set them on fire. They also had WT (Jif peanut butter) and Sullivan (Outback) and other $$$$ alumni so they are still on campus in what may still be the most expensive fraternity house in the USA. As for the ATO's, they were the drug house back in the day, not sure once they got moved to build the WTY Library. ATO's, SigEp's, Coo Birds, and AGR's all went under the bulldozer for the new library (built on a sinkhole) so 25% of the construction cost was concrete poured in a former lake and sinkhole.

That does seem a bit low, how long after the accident before he was tested? Seems .2 to .4 was where you woke up with the cops car in your garage and your dog super glued to the ceiling.
Wonder if he was texting and driving? Somebody told me this kills more these days than drinking and driving.

I understand what you are saying Prof...I’m just telling you what the state of Kentucky has on the books for underaged drivers...it is pretty strict with permits, teenagers meeting certain requirements before they get their license, etc.
The kid is not going to get charged with murder...but he will serve some time...may require to speak to schools about the dangers of drinking and driving, etc.

I hear ya, WildcatMike and we have similar laws in terms of pulling licenses. I just don't like the idea of a teenager getting railroaded on a manslaughter/DUI charge if he wasn't actually drunk. The whole mess is tragic enough without all that.

I am trying to remember what the kids got that ended the UK vs UT game trophy?
I think the Ragland kid got just 6 years for the sniper killing.
