Casino Gambling (issue no. 5) Removed From Arkansas Ballots

... Due to wording that technically included sports gambling also.
Geezus, you knew Oaklawn and their "friends" would find a way to kill this... I can't believe the Indian Casinos, their lawyers, and their lobbyists were dumb enough include sports gambling in the text... Simply amazing.
I'll just continue to gamble in Louisiana.....

The Arkansas Supreme Court today issued a batch of rulings in challenges to proposed ballot initiatives on casino gambling, tort reform and medical marijuana.
The Court has ruled ineligible for voter consideration the measures to 1) legalize three casinos in Arkansas and 2) severely limit damages in lawsuits against nursing homes and other health care providers. It turned down a petition to block a constitutional amendment to legalize medical marijuana use.
quote:
CASINOS: The Court said the amendment failed because the ballot title didn't adequately inform voters that the amendment allowed sports bookmaking, in conflict with federal law.

What is the difference between 6 and 7...they're both medical marijuana right?

Most of their revenues come from broke-arse poor people. They need to feed their 11 kids, and to waste money on mathematical impossibilities. We don't need these.

From what I understand:
6 - Covers fewer medical conditions and more heavily favorites corporate dispensaries
Initiated Act 7 - Covers more medical conditions and favors non-profit dispensaries and (I think) growing for your own use.

What happens if both pass?

Absolutely no idea.
The ARSC has dismissed the challenge to 6, but hasn't ruled on 7, yet. My totally non-legal-expert self wouldn't be surprised if they strike down 7, which is a shame, because it seems to be more focused on the person and not the corporate interests.
HOWEVER, Six is also a constitutional amendment, while Seven is just a statute (which means the legislature can "fiddle" with it after it (presumably) passes)..

Although I signed to have it included on the ballot I would have voted against it. It is just another in a series of amendments which would have created a casino monopoly while, ironically, the backers, as is the usual case, end up criticizing the other gambling monopolies for wanting to preserve their own monopolies. Pot meet kettle.
Maybe someday someone will actually have a proposal to set up a Commission like they have in NV or MS which have populations similar to ours where any person can go through the process to get a gaming license. Make it as much free market as you can and I think it would pass. People are always going to be skeptical of these line-your-own-pocket proposals. Of course the Lottery Amendment did pass but it was truly statewide and didn't seek to limit sales from particular places or stores.
The amendment concerning limitation of economic damages (Issue #4) was also kicked off the ballot; the medical marijuana amendment (Issue #6) was ruled that it would remain on the ballot for a vote.

Thank you for the info. I want more and they need to get the word out on the votes better or half the folks will be confused on their ballot.

Litigator is correct. Issue 5 was absolutely terrible. I'm pleased it was struck down.
I would vote for this.

My understanding is if they both passed whichever received the most votes won.
Next 6 has about 15 things you can get a prescription for
7 has about 52.
6 you can grow 3 plants
7 allows 7 plants.
6 is shite. 7 is much better
7 is like California and Colorado medical laws. 6 is some bullshite southern Baptist crony capitalism version where very few get to produce it, get the money, and very few get the bud.
I don't even smoke bud but I can tell you 6 isn't right.

great info.
so should one vote for both or just 7?
Posted on 10/14/16 at 12:17 pm to piggilicious
Vote for both hope 7 passes with most votes. If both pass initiative with most votes wins.
Posted on 10/14/16 at 12:19 pm to piggilicious
Just vote 7. Say no to 6. It's bullshite.
Posted on 10/14/16 at 12:21 pm to oklahogjr
Well if you vote both and I vote yes to 1 and no to the other atleast we know 7 has more.
But I've see #s that indicate that it's a 30:1 yes vs no. They will pass. So vote for the right one in the 1st place.

I always love this argument. Guess the arse backward Arkansans were the ones that constructed the wording of the amendment.
FYI, I supported the bill, but it never had a real chance at passing
