Ok Nico. It’s the Wild West. But here’s the solution. It cuts both ways.

Here’s how Tennessee should have handled the Nico situation.
So how would this work in Nico’s case?
In order to successfully do this Tennessee must meet the Nexus requirement.
So Tennessee is basically being extorted during a playoff run, then in the middle of Spring Training. So they expel Nico giving him an academic hurdle against future possibilities of playing with another university.
Will it hold up in court? Who knows but it sure could keep him in limbo for the remainder of his prime playing years. Fight fire with fire.
Nico your move.

Universities can expel students for extracurricular behaviors, especially if those behaviors violate the institution's code of conduct or create a hostile or unsafe environment for other students. However, the university must show a connection between the off-campus behavior and the school, and the behavior must have a detrimental impact, such as disruption or a violation of other students' rights.
So how would this work in Nico’s case?
quote:
Violation of Code of Conduct: Universities have their own codes of conduct that students are expected to follow. Violations of these codes, even if they occur off-campus, can result in disciplinary action, including expulsion.
In order to successfully do this Tennessee must meet the Nexus requirement.

Why couldn’t they just bench his arse? He wasn’t exactly lighting it up most of the year.

Why would you want to keep someone like that in your program??

I’m sure the university would rather move on and let him go his own way than to do that and be involved in the litigation that is sure to follow.

Of course it won't because we let a bunch of retarded political appointees make all of the decisions on something they are clueless about.
Wait until a federal judge rules that all revenue distributed to athletes has to be split equally between men and women regardless of the revenue those sports bring in.

The amount of men pretending to be women is going to skyrocket once there's guaranteed money in women's sports. Any high school boy with decent athletic ability would be better at random sports like volleyball or softball than the girls who get scholarships to play them in college.

That seems like a lot more work than just sticking his arse in the transfer portal.

Just make them qualify with the rest of the students. That will knock out most of the idiots. The market will create a minor league for the rest of them after they are done with high school. There are so many fledgling pro teams for the ones that can't make the NFL, I am sure they will create a league for the rest of them for the 3 years the NFL won't take them.
Yes there will be less talent on the field and there will also be less dumb penalties. I am good with it. The schools that are harder to get into will be the worst, and I am good with that too. This way the team is a true representation of your student body.

I have been advocating this for years...for the very reasons you expressed in the rest of your post.
However, the problem with the plan is that the schools who are elitist about their academics would start whining about how they are penalized because their minimum SAT is 1350 and some other school's might be 1100.
Right now... most of the more competitive academic P4 schools will let the 1100 guy in if he can ball.

Seems fair enough to me since the money would come out of the Athletic department, at least at UTx. Similar to how scholarships are handled is just fine and dandy. This money would have nothing to do with NIL anyway. UTX regret would be if amount of 'stipend' were to be limited and equal among schools.

What extracurricular behavior are we punishing here? What other student's rights were violated?

Just praying this isn't someone in Tuscaloosa right now.

Extortion, unethical business practices, but trying to obtain material advantage in compensation during a playoff run, failing to participate in Spring ball in order to obtain material advantage in compensation, probably blackmail, maybe academic dishonesty, and costing the school millions in lost revenue but more importantly it doesn’t matter. FAFO

I think a lawyer would argue that it does indeed matter.

Did someone really ask why they didn’t bench their starting QB in the playoffs? How about this answer - because the head coach didn’t want to be fired on the spot. Remember what this same fanbase did when Kiffen took another job? They acted like 4 year olds burning furniture and making a football coach some sort of villain just because he got a better job. And then they attacked his wife and family on top.

Being petty is not the way. He showed his arse and is paying the consequences. UT came out looking like heroes

Context. You left off FAFO. That’s like telling a joke without a punchline. And it’s precisely because of lawyers that it doesn’t matter. Some TPOS lawyer will figure a way to stick it Nico.
