Outside of Bama homers, this is the worst take I’ve seen on the situation.
Does Brandon Miller have the right to not be questioned about what happened that night? No, he does not have that right.
I guess according to Bilas, before deciding whether Miller can remain with the University, Alabama can’t ask him “Did you read that text message before delivering the gun?” No, that would be too insensitive to this young man’s “rights.”
In the event Bama already has the answer to that question, and it’s either “yeah I read it” or “I plead the 5th,” Bama must keep that a secret and can’t exercise any disciplinary action against Brandon? I guess letting the public know or simply taking disciplinary action for a general failure to meet team’s standards would just really be super insensitive to Miller’s rights.
Did Jay Bilas sleep his way through law school, was he just in the mood for a hot take, or is he the guy ESPN fed these lines to because ESPN is deep in bed with the SEC and thought they needed someone somewhere with credibility not lambasting the SEC’s top hoops team and the SEC’s arguably top program?

Look, it wasn't a pretty white girl or a white on black crime so the media doesn't give a frick about it. Bama isn't going to chop their own dick off and black on black crime facilitated by a future NBA star isn't a story the media wants to sell.

Bama can ask him but no one tied to a murder investigation especially in the role he may or may not have played should answer that.
You would be an idiot to talk to anyone other than your lawyer about that night.
Bama has options in handling this and none of them should be throwing questions at him concerning that night. He is at the very least a witness and an accessory at the very worst.

He has no legal right to represent the university of Alabama, that is a privilege. But Alabama is going the LSU Will Wade route here. Hopefully it has consequences for the university.

The people so upset about Miller still playing just can't get over the fact that the legal system has to this point said he is not at all at fault, and until that changes there is 0 reason to remove him from the team or the school. The melts about his from other fanbases have been beyond weird.

Bilas is right. The investigating police department is the one who doesn't have any duty to Miller. They investigated this matter, including issuing subpoenas and gathering witness statements, and concluded that Miller did not commit a crime or that they could never convict him of committing a crime right? Are you suggesting that the UofA should force Miller into waiving his constitutional rights or be forced off the team?

There is circumstantial evidence that any DA could use to indict Miller, if he wanted to. Miles texts Miller, "I need my joint a n****r rl jus got fakin". Miller delivers the joint to Miles. Miles hands the joint to Davis. Davis immediately starts shooting. Miller flees the scene. Miller does not report the incident to law enforcement, despite the fact that his car has two bullet holes in it.
Any DA could use that set of facts alone to indict Miller. Any DA in Alabama could use that set of facts alone to convict a black man 99 times out of 100. Why wasn't it done in Miller's case? You can draw your own conclusions.
