I'm sure he could afford an Uber. There's a good chance he didn't need an Uber or didn't think he was impaired at all.

You can watch a beer commercial and blow .02.

I don't condone drinking and driving. I'm just saying there's a very significant difference in someone blowing a .02 and someone blowing a .16.

I haven't seen anything other than message board/ twitter rumors that suggest he had a .02 BAC, so it's tough to know if I should grab pitch fork, torches and rally the facebook AU moms or look for the big AU rug to sweep this under.

I am one to believe he wasnt shite faced, but buzzed. What I am not doing is latching onto the lowest number that qualifies for a DUI and assuming he just drank a glass of wine at Effinas.

Im with you and totally understand your point. Im just responding to the "Drinking up to a certain level is legal".

I think the legality of it changes in certain situations like a accident.

you can be charged, but its not an automatic charge. It has to be proven you were impaired at the time of the accident, ie you were driving erratic. Or at least thats my understanding.

I dont think anyone is latching on to the .02 number as what he blew

His pic looks like he was about 2 or 3 beers in, maybe 4.


the .02 is just the floor to be considered a DUI for anyone under 21.


ETA: So it was .02. The lowest number you can be charged with.

Yeah, that's true. But it is due to lawyers arguing the "passage of time" theory. It basically says that if you have an accident and wait for the police to come and work the accident and get everything sorted and it is determined you have been drinking your BAC was higher at the time of the accident.

That's what happened to a friend of mine just a few years ago. He was at a dinner and someone ran a light and hit him and he ended up in jail because he admitted he had had some wine. Went to the station and blew a .068. They held him until he had processed the alcohol, but was still charged and convicted (assume that was at the discretion of the local DA or municipal judge) due to them saying he was "probably" over .08 at the time of the accident. His defense attorney told him there was not much he could do but file a couple of motions to dismiss but there was precedence and tons of people had their convictions upheld under the same circumstances. He spent a ton of money appealing that conviction, but he is under the assumption that he will never win.
