I'm not a lawyer but work with a lot of them. I think you need to show an attempt at requesting the misinformation be removed first before you proceed. Basically it can still go to court, but the judge would see it as you not doing your due diligence prior to the lawsuit.

I’m guessing it was some other white guy in the car with Miller(probably some other random student) and the NYT source mistook him for Kai. This is why you do your due diligence when you are eager for clicks
