A progressive customer totalled my car in 2015. They gave me more than what I would have taken, a few hundred more than what I could have replaced it for. It was a smooth process. No medical bills, no question on who was at fault. Just throwing that out there.

Actually there was question of fault, because the driver refused to respond to prog's attempts to contact and acknowledge... so they paid me and went after that bitch with malice.

They paid me for my car...that part was easy. No question of fault. Rear ended, totaled...here's your money. My rear bumper looked like a bird a kid would draw in kindergarten.

My issue is the best offer the initial adjuster made before transferring me to a different department was woefully inadequate to cover just the medical bills I already have.

They don't mess around with property because the legislature added on all sorts of penalties if they don't fairly adjust those. State Farm offered a client--years ago--a third less than the purchase price of his car. His car was hit coming out of the car dealership. In the drive way of the dealership.

They got everything on camera. Lady plowing into him. Her looking down at her cell phone the entire time. They made me file suit. Had to hire an appraiser. They lost and it was a really bad day for State Farm.

Matlock - Thanks for the insight and advice. I know you are a recovering personal injury attorney so I won't ask you to put a dollar figure on this situation. Just wonder if you think I am being reasonable in what I demand or if I am being naive in not demanding more in the way of pain and suffering?

Generally speaking, this is what the general outcome of a motor vehicle accident claim in Georgia ranges:

2 to 5 times your medical bills for soft tissue cases that don't involve surgery
5 to 7 times for broken bones
7 to 10 times for surgery cases
Death cases are a big question mark with no real good valuation.

Things can skew those ranges. Issues like liability or how conservative a jury pool may be will cause adjusters to deviate downwards. A rear end collision in Bibb County with an ER visit and chiropractic care is worth a whole lot more than the same facts in Houston County.

I'd say North East Georgia will be more conservative. (A Rabun County jury goose-egged a Plaintiff last week in a car wreck case). But you are still looking at being somewhere within the normal range. I still do a little personal injury, I primarily stopped because marketing is so contentious and I generally enjoy suing debt collectors more.

Thanks for the info. Glad to see I am not being unreasonable. 0% liability helps, I would imagine and yes, I expect a White County jury to be more conservative.

Seems like it.

Hey Matlock,
He mentioned that we are limited by the other drivers coverage caps. Seemed to indicate that if the other driver had minimum coverage, I may end up without even having all of my medical covered. Maybe I misunderstood, but is that accurate?

That's accurate. The rest you'd have to sue the individual for.

You need to be checking to see if the other driver has assets you can attach. Do it before they get hidden under someone elses name. Also verify if the driver of the other car is the owner.
My father-in-law once got hit by a guy that had little insurance and no assets in his name. Turns out he was a used car salesman for a big dealer in Atlanta and he was driving a car off the used car lot coming back from lunch. He blew .12 at 1:30 in the afternoon. He ran a red light crossing Scott Blvd going into the dealership and T-boned my f-i-l. Had he not listened to me he would have been sol.

The minimum limits do need to be increased by the legislature. If you have uninsured/uninsured motorist coverage, it will kick in. It's literally the best insurance you can get.

It should be easy to determine if the other driver owns real estate. 1 judgment against him should attach to everything.

Wage garnishments are another possibility. But you can't squeeze blood from a turnip (he has to have disposable income to make it worthwhile).

How are your uninsured motorist limits?
