Of course stealing is wrong. I just feel it's also wrong to intentionally put something somewhere hoping someone will steal it so you can punish them.

True story, my freshman year I actually forgot where the frick I locked my bike. By my senior year, I always wondered if it was sitting in the abandonded bike yard next to the Bus lot. I always wanted to jump the fence late at night after finishing my bus routes and looking for it. . I suspect it's long gone by now .

If he broke the lock and took it, then frick him.

But if the bike was just sitting next to a wall unlocked, how is that different than picking up a lost $10 bill. No seriously, how is it any different? It's not like it was sitting in someone's personal private property. No different than finding a bike on the side of a highway IMO.

Well, it's a bit different. Nobody is likely to come back to where they dropped a $10 bill, else they wouldn't have dropped it in the first place. I mostly agree about the lock: if there wasn't one then I'd think a decent attorney could get the charges dropped, and I don't consider this a serious offense. (sez the guy who has ~$10K worth of bikes in his garage and loves every one of them more than some family members .) If he broke a lock, though: to the dungeon straight away.

I'm not defending him, but if he absconded with an unlocked bike I think this was just stupid on his part, not a serious crime. It has nothing to do with him being on the football team (which by the way he hasn't played a single down for). KDS may decide this was stupid enough to get booted off the team for, and I wouldn't have a problem with that. But with what we know (assuming no lock) this seems minor to me.

Which is my point. Is taking an abandonded bike on campus any different than taking a bike found in a ditch? There is (I'm assuming) no lock, no name or ownership information, and has been left in a public area. I really doubt campus PD put a lock on it since no sane student carries bolt cutters on their backpack.

If there was no lock, cut the guy a break. Whatever happened to "Finders keepers, losers weepers"?

Suppose he got away with just a slap on the wrist...

What if the next time he's walking across campus he sees an unlocked car with the keys in it and decides to borrow it to get to class?

Obviously this guy is now a character risk. Do we really want to risk something worse happening?

I don't like the "What if" game. What if he planned on returning the bike but got busted first? I mostly agree with your "character risk" assessment, though. This was at best a very stupid move. I just can't force myself to get too worked up about it, particularly since it was a setup job by the PD.

I think for the stupid entrapment bikes the threshold should be that you have to give it 6 hours for the bike to be returned before you arrest and call it theft. If it was returned to the bike rack it came from within six hours then it's a simple $50 fine like a jaywalking ticket

Punishment that can be oh so easily avoided if you--guess what? DON'T TAKE SOMEONE ELSE'S shite.

It'd be one thing if they were forcing or tricking people into taking the bikes. Putting signs on them that say "take me for a ride-I'm free!" and then busting people.

Nah. Dumbasses who fall for bait bikes are the same people who would steal a regular bike from a regular student and get away with it. Nobody can bait you into being a theif. You choose to do that shite. Come on now.
