Might as well start this thread before Coonass gets here(not that it won't stop him from starting his own...)

Abram Family sues OM, IHL, NCAA, and 20+ others....
quote:
When autopsy reports were made public in May, it was determined that Abram died from complications related to sickle cell trait, exertion and an enlarged heart. Abram’s father said at the time that his family had a history of sickle cell trait. “But I don’t know if we ever even discussed it,” he said at the time. “I didn’t really know something this serious could happen because of it.”

Cliff Notes of the background to the story?
Posted on 5/17/11 at 10:50 am to DaleDenton
Walk-on dies during conditioning drills last Spring/summer. Autopsy revealed he had the Sickle Cell trait which lead to his death.
When we were told that we would have a lawsuit back in January, our AD backed our coaches saying that we followed all rules and procedures. At the time, the lawyer said that he would sue us for $10 Mill. The lawsuit now doesn't state any dollar amount.

So, if you know your family has a history of sickle cell anemia, you don't bother to find out from your doctors or ANYONE (internet included) if there are any risks to your child?
I would understand his statement of "I didn't really know something this serious could happen because of it" SORT OF. but, to know??
I feel for him deeply, though. I can't imagine losing one of my kids. I can't say if I would be looking for anyone to blame or if I wouldn't, or how I would be doing it.

That is unfortunate. How does an athlete make it through high school athletics going undiagnosed, let alone college?
A decade or so ago, there was an athlete Nutt was recruiting in Arkansas who was an excellent football player before being diagnosed with sickle-cell forcing him to quit playing before his senior year. The background was similar in that sickle-cell was common in his immediate family which caused the physician to check the kid during his yearly physical.

This will get settled. I still don't see how the Abrams family can throw all the blame at Ole Miss on this. I mean...if there is SCT in your family...then you need to go to the doctor.

my problem as well. They're saying that WE did know about it when we gave him a blood test for the physical but that we withheld that from him. That's pretty stupid to think that we'd withhold that info from him. Even if your just bashing Nutt........this was a Walk-on.

I agree. He went through both HS and Juco without getting diagnosed.

I think it is reasonable to assume that he played sports from junior high through high school which means there were plenty of chances during yearly physicals to test for the trait. This means there were several physicians who failed to diagnose the condition long before he walked on to Ole Miss' campus, and this is completely ignoring the family who has to know the diseases tendency to follow the genes in families...
It is unfortunate, but there isn't a villain in this story, several people failed to protect the kid, sadly, including his own family...

In the article, the family blames OM for not informing the kid of his blood work when he first walked on, yet the father claims he was aware of the sickle trait in his family history. If anything it sounds like negligence on the family's part

That is ridiculous. Why would a University knowingly set themselves up for a wrongful death suit? If anything, the parents should have taken responsibility of their child's well being. I know this sounds harsh, but by their logic, the parents were neglecting him thus leading to his unfortunate death.
I just hope this is a case of a grieving father looking for someone to blame with hopes of it making him feel "better", and NOT just him looking to make cash off his child's death.

Why did the University Drs clear him for play?

shite like this brings the worst out of people. Lawyers swoop in and try to capitalize on it. They`ll stir up a bunch of press, go on some talk shows, and all the while putting more pressure on OM to settle. Its a lose/lose for OM. Even if they win the court battle, they lose overall. shite like this makes me sick.

Agreed..

There IS a difference....but not much.
My hopes regarding the family is that this lawsuit ISN'T about the money and instead will be a suit that will help prevent future deaths. I have a glimmer of hope about that being that we were told back in January it would be a $10 million suit and now there is no dollar amount listed.

Maybe they didn't test for it.

He had been cleared to play at Jr High, HS, and Juco levels. I've yet to see where we KNEW that he had the SCT before the autopsy. The family said they think we knew but we haven't stated that as of yet.

Very true, but it still isn't OM's liability. Not that this matters at this point in the case, though.

I'll wait and see what it is they're demanding before I pass judgement on them.
Like I said....If they're just trying to make changes protocol across America to prevent more deaths by the SCT, then I'm actually ok with this suit. I hate that my school is involved....but I'm ok with the suit overall.

If Miss is found negligent it wont matter if they knew of his condition or not. You take the victim as he is. Its commonly known as the "eggshell plaintiff." Because of this they'll probably play it safe and settle.

I meant this in regards to attorney's.
