1) The buyout in the contact reads the cost of the buyout is in the “sole discretion” of Washington.
2) The contract specifically states that “the institution is not obligated to enter the Student-Athlete into the transfer portal or otherwise assist or facilitate the Student-Athlete’s transfer to another college or university.”
Oh boy

Uhh....all he has to do is unenroll at Washington then enroll at LSU. Doesn't have to enter transfer portal
Honestly, what's stopping any college athlete from doing this that wants to at the beginning of each semester? Or does the start of semester enrollment periods even matter anymore for these paid players?

Courts. Washington has not put his name in the portal. Earlier today they stated they would go that route.
We will see

Schools cannot legally eliminate student-athlete rights through the NCAA with contracts.
That clause is null and void, and entirely illegal.

He should have to pay his NIL back

I can't blame Washington for trying, but they won't win here. I would put good money on it. In the meantime, they are likely just making Demond want out of there even more.

Guess you never heard of non compete.
Most of which are deemed non-legal and apply to employees, not non-employee students.

I beg to differ. A contract is a contract. He hired an agent and that agent should know what he is doing.
He signed the contract in a business decision. He can be held to that contract.

If contracts are completely unenforceable, then just recruit your opponents players at halftime…
Except that violates NCAA by-laws. Slightly different since this is trying to go around the NCAA by-laws and student rights to advantage the schools.

So Washington had him sign a contract that runs afoul of NCAA bylaws? And they want to explore their legal options of enforcing said contract?
Further, a broad non-compete like that (which is effectively what that clause is) is rarely upheld by the Court. And the "buyout being at the sole discretion of Washington" is likely not enforceable either. You can't have a liquidated damages clause that is broad and vague and then try to enforce it.
I'd encourage you to look at Xavier Lucas from last season. Same basic fact pattern. Lucas signs NIL deal with Wisconsin, changes his mind and wants to enter the portal. Wisconsin refuses to enter Lucas' name in the portal. Lucas sues and disenrolls from Wisconsin, enrolls at Miami. I'll let you guess where he played football this year. (hint, it wasn't at Wisconsin).

Fine, then NCAA could then rule him ineligible, sanction Washington for breaking NCAA by-laws with respect to NIL deals, and he still doesn't play football for Washington next year

Remember this. Players could not be paid because it was against the NCAA by-laws until a court decided the NCAA could not stop that.
A court is going to end up deciding this.

LSU fans are being short sighted and defensive as usual here when the school he is leaving is immaterial to the problem at hand.
What’s fun is many of y’all have said that these unlimited transfers with no consequences need to be wrangled in.

If part of the contract is illegal, the whole thing is null and void. This is why attorneys get paid good money to write these things up and include very specific language. Do you think if you sign a contract that says you agree to be a sex slave for 30 years that you are going to be held to that by a court?
