I’m looking and I can’t find what the exact rule was on booster/NIL activities were….and this is important…at the time the trip happened. The NIL guidance from the NCAA has been a constantly changing mish-mash of unclear rules, guidance, and policies. Charlie Baker even said as such not even 3-months ago admitting there are no rules and was calling for national regulation. At the end of the day, any control the NCAA wants to put on it is in violation of the Sherman act.
As far as the lawsuit, it doesn’t look good for the NCAA. Their batting average in court is abysmal, and I doubt the AG of two states would sign on to a lawsuit that was a loser. Maybe I’m wrong, who knows.
We’ll see what happens, but I’m betting the NCAA loses this.

Looks like the guidance on reclassifying what a booster is to include collectives and corporations was instituted in May 2022 by the NCAA.
For whatever it’s worth, the Nico trip, arranged by Spyer, happened in March 2022.
How can the NCAA punish a school for breaking a rule that didn’t exist? And do we all believe UT was the only school doing this prior to May 2022?

Doesn’t matter. A corporation nor a collective can pick up the phone and call someone. Neither can they type an email. An actual person has to do that. In the case of Nico, the person that contacted him was a Tennessee booster. The person that arranged the travel was a Tennessee booster. The same person that bragged about using NIL funds to recruit. This is a booster issue, not a NIL issue.

Again, in terms of the booster definition, spyer or whatever it is didn’t fit in that definition. It could be run by boosters, it could be funded by boosters, it could be owned by boosters, but the collective itself is an independent entity. As long as they are not promising pay for play at a specific school they were free to fly whoever they wanted for whatever reason.
That changed in May 2022, with more rules on collectives as boosters, but the trip in question happened in March when there was no rule against it.
Are we all in agreement with the NCAA applying rules retroactively?

I guess we’ll see the outcome of the court ruling on this. This feels like selective enforcement. You can’t tell me UT is the only school with a collective made up of “boosters” doing this prior to May 2022.

I don’t really see this as a bright side but to each their own I guess. My concern is that what you like about Tennessee football and what I like about Carolina will be so altered that we lose interest which is just unfortunate.

I'd love for the NFL to make a farm league. All those wanting an instant payoff would go play there, and we could go back to watching actual student athletes playing the game we love.
NIL would disappear, as if someone was actually worth a lot of money he'd go to the farm league.
