We know that clause means nothing to the NCAA or else Bruce Pearl would've had been responsible for Chuck Persons wheeling & dealing with the AU alum parents of active players. Persons was Pearl's Asst HC, reported directly to him and it's been years now with nary a peep from the NCAA.

Amazing that the vol's fans have two great choices here.

Either hope for harsh NCAA sanctions to exonerate the idiot chancellor in her claims or root for harsh NCAA sanctions to prove Pruitt a liar.

Here is the basic timeline of events

November 13, 2020: new chancellor says credible source reported NCAA violations to their office

November 19, 2020: UT retains law firm and begins internal investigation of allegations

December: NCAA opens investigation after UT informed the SEC and NCAA about allegations of infractions

January 14, 2021: Pruitt is interviewed by NCAA enforcement staff and attorneys retained by Tennessee. Pruitt's meeting lasted 7 hours. He was represented by separate counsel

January 15, 2021: Law firm meets with UT officials; thereafter, 10 football staff members are fired, including Pruitt, Brian Niedermeyer (ILB coach), Shelton Felton (OLB coach), Danny Stiff (director of player personnel), JT Hill (arse. director of player personnel), and others in the recruiting dept and one quality control coach. Philip Fulmer, the athletic director, also received walking papers

I think what's funny is people are arguing as if Pruitt has no idea what he's been accused of doing after having met with NCAA officials and UT officials for 7 hours. He knows exactly what the alleged violations are. It's also important that the UT Chancellor who made all these decisions had only been on the job for just over a year. She has degrees from Texas, SMU, and North Texas so it's not as if she's some old guard UT figure who been a part of whatever has been going on there all along.

Another important thing to note is he hasn't actually denied any allegations. He said early on he would defend any allegations, which isn't a denial. And yesterday, his attorney's letter, again, didn't deny any of the allegations regarding Pruitt but rather threatened to expose things about Tennessee. I take that as Pruitt thinks he can defend his violations because others at UT were complicit. Given how many other people lost their jobs over this, that UT self-reported all of this stuff to the NCAA and SEC, and that there is still an open investigations with the NCAA, I really don't think Pruitt has a strong hand right now. UT's lawyers wouldn't be taking such a hard-lined stance on not paying him anything if they had any real concerns. I know people like to put on their tin foil hats, but if they had the exposure Pruitt thinks they do, they'd have settled a long time ago.

All of this just reeks of desperation to me.

Just out of curiosity, if they did settle or the attorney otherwise decided not to divulge this information, could any other entity seek out what they supposedly know?

I assume the NCAA still has no subpoena or similar power to act, unless it is essentially handed to them by someone else.

Not that I can think of. The NCAA doesn't have subpoena power, and if this never goes to Court, I can't think of any other way anyone could get this information. Maybe an FOIA request if there are transcripts from the meetings he had with the NCAA and UT officials, but that wouldn't include this other stuff Pruitt's attorney says they have. I also don't know whether an FOIA would work. Courts have denied them in the past when media outlets have tried to get information about NCAA investigations with that method. There are federal privacy laws for students that makes obtaining that information a hurdle.

UT has money, hell they have paid 3 staffs at once once than a few times. When Pruitt was fired with cause it was about him and his personality, not money.
