If it qualifies. It likely would. Federal courts are courts of limited jurisdiction, meaning they can only hear cases authorized by the United States Constitution or federal statutes. This might be framed as a right to work case.

Wouldn't be possible to disagree. The player isn't being deprived of eligibility. The school can choose to play the player and pay the penalty.

The point is they are being deprived of economic opportunity they could receive at said school because of the rules that a conference imposes on a member school which is a part of the NCAA.
This is very similar to how flow down terms in contracts get negotiated.

I understand your point, but I can see the courts seeing it the other way. Even more so now that players are paid out of revenue share that the SEC is threatening.

LSU abstained from the penalties vote, but not from the creation of the prohibition vote.

Answer this... if a college player making money in college has an opportunity to stay another year, would he? Especially if he isn't sure he'll make it in the NFL?
Then again, the SEC was good with a sore throat QB getting a sixth year.
