I'm with Bella. I hate that the tree was poisoned, but Auburn was slowly killing the tree anyway.
And to the poster who said it was your tree. Isn't Auburn a state institution? That would make the trees state property. My tax money will probably go to prosecuting this man and trying to save the tree. Or to the removal and cleaning of the soil so other trees can be planted there for future Auburn fans to kill.

See parkjas, I can take it.
I obviously don't like what Harvey Updyke did. fricking redneck needs to be excommunicated back to Texas.

Taken from another site. Some are saying he was a retired Texas Trooper.

There our trees, we can do what we want....Rolling toomers is our tradition, Bammers can laugh at it if they want, but this guy went overboard...
You are not allowed to destroy others folks property... The law is on our side here, public perception is on our side...
This pretty well sums up my opinion, too. I'm really sorry this happened.

Sorry Rummel, but you are wrong. Plenty of people make fun of his actual death. And yes, you are right parkjas. If you can make fun of or dead coach, then we can make fun of your dead tree.

PPl dont make fun of BB...they make fun of bama fans who wear houndstooth 30 years later and put tattoos all over their body of the man.

Is Harvey not the dumbest person alive? I knew he would be easy to catch up with.
1. He uses a poison that most folks would not know about.
2. He does it in front of live cameras
3. He calls a radio program to brag about it so the call can be tracked.
Off with his head.

Just curious of 2 things... 1. what idiot posted bail for this clown? (I'm saying there is no chance he could afford $50K himself) 2. why on earth does the guy wanna be free right now with all the barners out for blood? I think I'd rather be locked up than have to deal with barners right now.

IF the trees die, which is likely... It is very possible the wood will be used for making Plagues, etc. with the the Creed, etc. on them... could sell them to help pay for the restoration cost... I know I would buy one and so would a lot of the Family.

he could make millions if barners attack him...

Lies, and you know it. Well, they do make fun of those things too, but they also make fun of his death. To believe otherwise means you are denial I guess.

If he only faces state charges, my guess is he will be charged with 1st degree criminal mishief, which is a class C felony and carries a maximum sentence of 10 years (which he will not get). If the feds bring charges, I have no idea what it will be.
Ultimately my guess is probation, lots of community service and high restitution fees.
Sorry if this has already been provided, but something similar happened in Austin, Texas in 1989 to a historic live oak called the "Treaty Oak".

Dude who poisoned that tree was sentenced to serve nine years in prison.

This really is a travesty and shocking to the conscious.
I do wonder, though, if Auburn hadn't been so open, obvious and brash about its lack of respect for the rules and/or if Slive or Emmert grew some balls, would this nutjob feel so compelled to vigilantism?
