He called her first thing in the morning for 4 days straight. You would think he would know something was amiss. And how much of an even bigger a-hole is Petrino for openly flaunting their relationship to be texting it so openly where the boyfriend could have easily found out.

There's no need for reporters to have to answer to anyone about why they're doing it. They're doing their job. This was the highest paid state employee. This is part of the job he signed up for, so there's nothing that should surprise anyone about this being out in the public. Arkansas has a pretty broad FOI law. You can check it out here (not that I expect you to)

For a quick idea on what is accessible by the open records/open info law, think about it like this: an FOI request is like a faster but less powerful subpoena. If Bobby Petrino saved his text messages on his state-issued laptop, maybe that would be FOIable, but otherwise, his phone records are probably the only glimpse you'll get into what he was doing on his phone. There is no reasonable expectation to keep the content of messages saved anywhere but the phone, and I'm sure those are gone. If anyone has any questions about the mechanics, I'll try to find my old copies of Arkansas media law books.

These records indicate an abuse of state-owned equipment used to further an inappropriate university relationship. Yes, it is news. Yes, the taxpayers that paid these cell phone bills have a right to know.

Does it really matter who requested the records?
Seems like Petrino would have learned a lesson or two from his predecesor's indiscretions with text messaging on the company phone.

Depends on when she sent them. She might have kept her phone on vibrate (there's a joke in there somewhere) and made sure not to text when he was looking.
I feel bad for the guy though. He got fricked over big time.
