(e) Have been involved otherwise in promoting the institution's athletics program."
Sections D and E are what qualify Spyre as a booster. They are providing benefits to enrolled student-athletes and the have promoted Tennessee's athletics program.
The most obvious way to see section E is to look at Spyre's website.

This has been done to death, they are in east TN and the Volunteer Club link is a wall separation from what they do. Can they do business with the Volunteer Club? Absolutely, they do business with anyone that wants to utilize their services.
