Heh. Actually I can't imagine Gordon or JJ doing this, but maybe I'm overly optimistic. Happens to everybody, but my guess is if you pointed out the error to Dale he'd have no idea what you were talking about.

No way this goes criminal. Probably a case there for negligence but that too wouldn't be an easy conviction.
Civil settlement for sure. Pay it and make the story go away as quickly as possible.

What now for Tony Stewart though?
Two hotheads come together on the track and one of them is killed. Tony Stewart has a reputation for bumping and wrecking his opponents. He's a classic bully, at least on the track. Is that a good thing?
Does he have empathy? Did he mean it when he said, "No words can describe..." Is he a bad role model?
I've never liked him or his racing tactics. I've always thought he should not be racing because of the danger he poses to other drivers. He has a win-at-all-costs outlook. His skills as a driver are over-shadowed by his willingness to wreck other drivers. He seems to think that that is an acceptable part of racing.

Sorry but I don't blame TS even a little bit for this. You don't leave your car on a racetrack. All of your protection is in that car. If you are stupid enough to leave your car you don't walk toward other racecars that are zooming by and try to play chicken and talk mess to them. The way he was on that track between himself and his car he left less than half the track that was safe to drive on while on a curve on a dirt track.
I know it is difficult for his family but the guy was a complete idiot and had no business racing. IMO any race driver that gets out of his car during a race (outside of a fire or other dangerous situation) should be banned from the sport. They spend all this money on making the cars as safe as possible and protecting the drivers but if you get out of the car so you can point your finger at other drivers you have no business in that sport. If the sport will tolerate that behavior then it is also to blame.
I'm sure TS will settle with the guys family but honestly he shouldn't have to and I seriously doubt any jury would find for the defendant.

Stewart has been known to get out of his car and he once threw his helmet at Matt Kenseth's windshield on the track. I blame him for establishing the current bravado culture in NASCAR.
I agree that this shite has to end. Banning would be appropriate for what has now proven to be a potentially deadly act. I doubt that anyone would do it for a while but over time I can see it coming back because the customers love it.

Whether it is Stewart or anyone that gets out of their car they should be banned or severely punished to the point where they don't ever think of doing it again. My comments to TS are strictly to this event.
I watched the video again and when he hits the guy it was insane how far down the track he had gone and made the space the drivers had to work with far too small. This isn't baseball where you can run out on the field and argue with an umpire, the umpire isn't driving a few thousand pounds of metal at high speed.
There is just no excuse for leaving your car on a race track outside of a fire or personal safety issue. Period. You can't stop stupid people from being stupid but you can damn sure penalize the behavior.
The moment that guy left his car to yell at TS he took his life in his own hands. As to whether or not TS could have missed him or not that is something between him and God at this point.

I agree that the kid was being an idiot, but you can clearly hear Tony's engine rev up as he's approaching.

Which still is supported by the theory that he is focused on throwing dirt on his car and not realizing the idiot actually jumped out of the car and is on th dark track.

I agree. It'll be interesting to see how this incident affects Stewart going forward. Will it change his overly-aggressive behavior on the track?
I don't think there's enough evidence to say that Stewart deliberately hit him. Did he mean to buzz Ward and "teach him a lesson?" I can see that based on Stewart's past behavior.
