Chicago: 7 charged for Monday's machete attack

Fricking heatherns. Wished the victim had been a new CC holder and had taken those folks out. At least they were caught.
Someone, please enlighten me on how a machete to the head doesn't get an attempted murder charge.

She said the blow left a gash 6-inches long and 1.5 inches deep on the man’s head, adding that the attack was captured on Chicago Transit Authority surveillance video. The man was taken to an area hospital, where he received about 30 stitches.
The police department said the seven were all arrested about 45 minutes after the attack not far from the station.
At a court hearing on Tuesday, the four men were formally charged with felony counts of robbery, aggravated battery with great bodily harm, and trespassing on CTA property.

But only the big scary looking machetes. The ones with gay rainbow handles and such we can keep those on the streets because they aren't as dangerous.

Just took a quick glance at their statutes. It looks like a pick-em on the part of the DA. If I read them correctly, both crimes are what they call class 1 felonies.
Maybe the elements of the assault charge are easier to prove?

I'm too lazy to look up Illinois statutes, but, in Texas, it's pretty much a pick 'em as was mentioned earlier. For Aggravated Assault all the D.A. has to prove is that the defendant caused serious bodily injury. For Attempted Murder, they have to prove beyond a reasonable doubt that the defendant intended for the victim to die. Since they're the same grade of offense with the same penalty, why set the bar higher for yourself as a prosecutor?
