A garbage collector outside Atlanta has been sentence to 30 days in prison for start his work too early.

Kevin McGill, 48, who works for Waste Management Inc, took a guilty plea deal after violating an ordinance in Sandy Springs, north of Atlanta, that bans collections before 7am.

He turned 48 on Friday, but reported to a local jail at 6pm after being allowed to serve his time on the weekends so he can still work collecting wealthy residents' trash so he can support his wife and two children.

The bin collector didn't have a lawyer when he was sentenced and has filed a motion to withdraw his plea, McGill's new attorney Kimberly Bandoh told Daily Mail Online.

quote:

However, the Court Chief Solicitor Bill Riley asked for a 30 day sentence for the offense of picking up trash around 5am in the suburb and the judge granted the stiff penalty

quote:

Mr Riley has stood by the request for jail and says that 'fines don't seem to work' and 'The only thing that seems to stop the activity is actually going to jail.'

The solicitor said that residents of Sandy Springs, which include professional athletes and executives for Delta Air Lines, begin calling 9-1-1 when they hear early garbage men, according to WSPA.

He said it was the right decision to punish McGill, who had only been on the route for three months, rather than his company, which the city has contracted to pick up its residents' trash.

This is usually my first move when I hear strange noises outside, too. Garbage men, and especially the sound of their trucks scare the shite out of me.

This was probably just ISIS reconnoitering for future attacks. Nice try, frickheads...the residents of Sandy Springs aren't so easily fooled.

They're too busy dialing 911 to get out of bed and see WTF is going on, or to recognize the sound of a garbage truck and its workers. Must be a nice life.

Seriously though, I'm not sure what pisses me off more...these pricks using 911 because of a fricking garbage truck or that dick that would rather send an hourly employee to prison instead of fining a multi-billion dollar company.

I highly doubt this dude just shows up at 5 a.m and takes the garbage truck out for a ride when his superiors tell him not to.

Saw this on reddit earlier. I don't even know. Insufferable people. Hopefully the exposure of this benefits Mr. McGill .

Do you "Men at Work"? Emilio, Charlie-brothers on screen and IRL. It just doesn't get any better.

She said that Waste Management, which had amassed thousands of dollars in fines with the municipality in the last year, suspended McGill for violating its policies before he went to court.

Sounds like they tried to fine the company and they didn't give a shite. Also sounds like the company threw him under the bus. He should have hired a lawyer.

If it's against the law, it's against the law. I would give him a pass of he didn't know about it but sounds like it's happened more than once.

They did give him a break by allowing him to work while also serving his time

It's weird that even though the Nazis lost WW2 their influence is still so pervasive in today's culture. Not sure how they pulled it off.

This.

They don't provide garbage pickup as a municipal service. Instead, they let companies compete for customers, which probably keeps rates down. They've also got an ordinance that says no garbage pickup between certain hours. It is their city and if they don't want to hear the trash truck at 0430, that's their business.

The companies have been paying the fines because it is cheaper than buying more trucks and hiring enough drivers to service their customers in the permitted time frame.

He's got an excellent civil case against Waste Management. As someone else said, I seriously doubt he's so motivated that he wanted to go out early. They certainly made him brazenly violate the law to keep his job and as a result he got arrested. I'm no lawyer, but it sounds like he's going to be getting a check.

Don't blame the city any more than you'd blame them for arresting the guy who decided to park in the middle of the street and block traffic to peddle his wares. The blame for this guy getting arrested rests solely with Waste Management.
