Bama sues Daniel Moore....again

I mean this guy is like the redneck Michelangelo for the University. Do they really need the licensing revenue?
And as an aside, I would be curious to hear from the lawyers on the rant how one can regulate "art" and what an artist paints.

I really don't know why they do it, it pisses me off though. The guy does great work and it's good for the school IMO. I guess by the letter of the law the school is right, but does that mean they have to take action? Just seems petty.

I think if you polled 10,000 Bama alumni and fans, 99.9% of them would oppose the University pursuing this suit. Its ridiculous.

Understand, I'm not saying this as a flame, it just looks bad. Very similar to when Auburn wanted to change uniforms from Russell Athletic....who happened to donate millions to the University's textile department.

Incorrect. As much as I hate the lawsuit against an alumn, it is about precedent. Others could use the fact that the University doesn't exercise same requirements to all vendors.

The University likely couldn't care less about the 3-7% of what Moore makes ($30-70K wld have been University's take on the 2009 paintings). It is about protection from others. They've spent way more in legal fees fighting this than they would have made from Moore. It isn't about Moore. It's about everyone else...as crazy as that sounds.

Just asking, because I really don't know. Didn't Moore do a painting last year for Auburn's championship? Did he sign an licensing agreement with them? If he didn't have to do it with Auburn or any other school, then why should he have to with us? Also, in his paintings he depicts players from other schools, so does he owe those schools anything? It's really confusing to me, and I've just never heard anyone say any thing but what Bama has demanded.

True, but haven't they already dismissed other lawsuits against him for the same thing?

He did do a painting as to whether he had a licensing agreement I have no idea.

I was going to post this same message, and I "understand" what they are doing, but the negative attention from continuing the fight has far exceeded its purpose. UA has cost Moore hundreds of thousands of dollars in legal fees, so I think the precedent for how it would approach others has been set. They should have walked away with the ruling that prohibited the images being put on coffee cups and calendars, but allowed him to continue selling original art and prints.

If the let Moore do it than others can sue UA for an unfair competitive advantage.

UF sent cease and desist letters to High Schools using the Gators exact helmet logo. Greedy is right. Those schools had to spend lots of money changing their shite at a time when they don't have money to spend.

I know you have to protect your "brand" but damn.

A Christian school in Prattville got a letter from Penn State this fall for infringement on their logo....like Penn State didn't have bigger fish to fry.

You would think Penn State, for recruiting purposes, would want as many high schools as possible around the country using their logo.

As for Daniel Moore, the guy makes millions painting exact replica's of a sporting event and image he does not own. What if FOX decided it would start broadcasting UA games without paying the university and SEC royalties? Should any old redneck be able to make Alabama t shirts?

Moore is just as greedy for not being willing to pay 3% of his millions to the University he uses to make the millions as UA is for demanding what it is entitled to.

Alabama's not being greedy.

If they don't protect their intellectual property rights, then they can forfeit them. That's a bigger loss than any one painter like Mr. Moore.

A&M has to do the same thing with our trademark "12th Man" ... it sucks, but it's the law.
