i'm not a TN lawyer, but i'm pretty sure

any DA who isn't trying to make a point will reduce it if they plead out, however

i see 1 or 2 guys taking the fall and saving one, like Odom/Benton for R

Yes the KPD already said it was no diff than using a real gun.

Not Federal prison. Unless Tennessee is different from most other states, even if it was a real gun you wouldn't go to Federal prison. Even if you committ murder you end up in state prison, unless it is a federal offense and you are prosecuted in a federal court.

The type of gun shouldn't make a difference I wouldn't think - the victim didn't know it wasn't a "real" gun, and if it was brandished/used in a threatening manner it is still the same.

As SFP said, people don't go to federal prison for breaking a state law. They are, however, facing very serious felony charges from the state of Tennessee. But, in all likelihood, they will plead to something or get Youthful Offender status, and not face a huge amount of time.

The pellet gun thing is irrelevant. They held themselves out as it being a real gun, and what is important is that the victim thought it was real. It probably will factor in to the DA's decision whether or not to be a hard arse, though.
