Are all these crazy NIL deals guaranteed?

Like if a guy blows out an ACL in the Spring, is he still getting his bag? Are schools able to have any protective clauses at all? What if a guy is just a complete head case and has to be kicked off the team, is that the same as a guy who gets benched as far as paying out the dough? How can any team pay a HS guy NIL money and then let him sit for a year? That’s just going to be a complete sunk cost because the player is just going to walk or ask for more money having contributed nothing. This would probably be a fascinating case to study from the economic perspective.
Just this season you had guys like Nuss and RW not coming anywhere close to producing at the rate they were paid. Cam Coleman probably fits that description as well. Though the whole AU cluster F obviously contributed, he had some drops and alligator arms. I mean, only one team can win it all, and a whole lot of money is going to guys on teams that have little chance to actually compete for a CFP spot, much less a championship.

If I invested a dime, there would be conditions on it. Otherwise it makes no sense unless it's just throwaway money by some of these people. Maybe it is.

I'm sure there are some "for cause" clauses in their contracts. Not much good for NIL if a player gets kicked off the team.

Supposedly Nuss was hurt all year but these deals do need to hold players accountable, by either a contract or performance expectations... or both.
And one year deals shwould be for players that only have 1yr left.

This is exactly Georgia's position against the player that took their money and went to Missouri. Georgia said they were paying for his NIL rights and with him in Missouri uniform it didn't help Georgia. Now the thing is, the contract had a buyout clause, similar to a coach buyout, that was to equal the value of the entire contract.
We nèd to keep an eye on this law suit as it could have a big impact and be a way to slow down the players jumping.

This one of the big advantages Texas has over all other SEC schools. Largest metroplex of all the schools and a hot business city with corporate ties.

Yes, most are guaranteed. Otherwise it is pay for play without even looking like an NIL deal

It’s an important point because the only thing enforceable is the contract.
We all know it’s not what the contracts are actually for but that’s what the contracts say they are for.
You can’t walk in a courtroom and say this guy owes me money because he agreed to something outside of what the contract says the money is for.

The rule has to be fixed. The NIL cover is a veil meant to be ambiguous and unscrutinized meant to hide the real intention of NIL that has big teeth- pay for play.. NIL cover in recent years leaves the schools holding rights without enforceable parameters and distinction thus the players can get bored after a month and hit the road.
Teams do not own a player's rights accrued under NIL. A team can pay Cam Coleman 1 million for his rights, but then Cam heads to another team the next week. Did the rights disappear? He should be sued by original team for putting on another team's jersey and playing, not because the school owns his playtime but because they own rights the player decided to give to team B

If I am a big money booster, and I pony up for the multimillion dollar recruit/transfer, I’d want to have some guarantee that the NIL I pay for isn’t associated with a school that would devalue my business by association in 12 months. Can those independent businesses not put some contract language that locks that in to some degree?

There isn’t much that can be done legally. And a lot do seem to mail it in after getting paid.
