Did they get caught up in the "If Penn State did it then so can we?"

One thing Penn State has is money.

No doubt a bunch of drunk boosters sat around in Tiger Stadium in the second half of the Aggie game and said this. They pledged to cover the buyout then sobered up the next day and realized what they did. It’s the only explanation.

It’s not his salary, but his buyout in case he’s fired. He had a for clause contract with stipulations. His contract read; said employee can be terminated for a serious and legitimate reason, such as violating company policy, committing misconduct, or failing to meet job performance standards despite warnings.


They are trying to swing the latter.

BK sucked and didn’t hold up to anticipated performance standards.

Kelly's win ratio is around 0.75 during his stay at LSU. I don't think
LSU can say Kelly didn't meet job performance standards.

Do you feel that is LSU’s standard? Employees are relived of their position all the time, based upon standards, even if they “feel” they've done a good job. Maybe that did, or maybe the boss didn’t think they were. Either way, standards are arbitrary and can be determined based upon substantial evaluations.

Meaning in its simplest terms; have you completed the process or “substantially completed the process”.

Legally standards are argumentative and I will assume based upon what’s happened, He will want to negotiate, but his attorneys probably won’t allow him to, because they’ll get 40% of whatever he takes home.

Of course it does. As an attorney I can tell you, it’s not one sided. Contracts are never sealed and done deals.

It’s like non compete clauses. They rarely hold up.

It’s pretty iron clad, in this case, for BK. He didn’t do anything that would get him “for cause”. The contract is posted on the Rant. LSU screwed this up. Even if they wanted to invoke “for cause”, they had to do it with a 7 day notice prior to firing him. They did not. He has emails that back it up, as well. Imo, he will end up walking with 45mil, or more. LSU has embarrassed themselves and it’s all out in the open. This is going to hurt. Oh well, hate that for them.

He is not a good coach, but LSU has to pay the man, this is on them not him.
