Georgia law makes it a DUI if you are under 21 and have a BAC of .02% or more. That is one beer and a bullshite law. A young college student shouldn't be facing jail time and a DUI record for drinking one beer. If you want to charge him with underage drinking, then do so. Georgia DUI law

I wish all who have only driven at .00 for their driving history could never post again. Would be interesting to see how much traffic were over here. I'm guessing no change.

Its to discourage underage drinking and driving. He was arrested on a violation of a law that exists. Whether you agree with it or not is irrelevant.
However I don't think he needs the book thrown at him. He'll get a pretrial program which will include community service, put on an alcohol course, and maybe probation.
He's a young guy who made a mistake that he'll hopefully learn from. I wish people here wouldn't go ballistic just because someone was arrested at a school that isn't the one they root for.

Underage drinking and reckless driving with a driving under the influence charge at UGA is a flex not something to be punished for.

He was drinking underage. Your focus on .08 .05 doesn’t matter.

Any level of alcohol in your system will affect your driving. If a cop pulls you over, they can administer field tests that will test your sobriety. If you seem unable to drive and blow below a .08, they can still charge you. There’s also a charge called a DWI, or driving while intoxicated. This may apply to you because while you’re under the legal limit, you’re not driving safely and are putting yourself and others at risk.

You’re off on this. Less safe is not a lesser charge under GA 40-6-391, the dui statute. There are multiple ways the statute can be violated with less safe being but one of the ways it can be violated.

The legal limit in GA for someone under the age of 21 is .02. Being under 21 is not a lesser charge. If he's under 21, he can also be charged with underage possession.
There are two DUI charges under 40-6-391 O.C.G.A.
One is for less safe. The other is for per se (over the limit). Neither is a greater charge than the other. They carry the same penalties, and a person is often charged with BOTH.
If he refused the tests, there wouldn't be a BAC thus no per se charge; however, refusing the tests is an automatic license suspension for one year.
If the officer requested a blood test, the results would not be available at the time of arrest. The blood is sent to the GBI Crime Lab for testing.
DUI is also more than alcohol. A driver who is stoned but not drunk wouldn't get the per se charge at the time of arrest. A charge of DUI drugs would be added once the lab results return.
