NCAA Backpedalling On UT Investigation

Sounds to me like they're trying to leave the door open to either;
a) close the investigation and try to head off the judgement (hoping the Judge will dismiss the case as there is no investigation), or
b) lie and claim there never was an investigation (hoping the Judge will dismiss the case as there is no investigation).
So basically, leaving the door open to turn tail and run
(a standard tactic for defendants in civil suits which are going bad for them).
Honestly, it's their best play right now. They'd be smart to do it, but I hope they won't.
I want a judgement. I want a spanking.

So let's recap:
1) The NCAA leaked that there was an ongoing investigation of Tennessee.
2) The states of Tennessee and Virginia then filed a federal lawsuit plus a request for a restraining order against the NCAA.
3) In the meantime, the NCAA still has not communicated any investigation to the University of Tennessee.
4) And now the lawyer representing the NCAA in federal court claims to have no knowledge of any investigation.
Clear enough?
