Why has he not been charged with a crime?

It’s generally hard to convict criminal offenses because of the requirement you have to prove intent. But it’s not hard for a Uniiversity to look at a situation and say this player’s conduct does not meet our standards and should not be participating on our team. Unless your Nate Oats and Alabama.

I’m sure he thought Miles had no purpose or intent at 1:45 AM when he brought it to a crowded area after they had been drinking all night.

Even if he isnt criminally liable, any player that was there and played some sort of role in the murder should be kicked out of school. Bradley
and Miller should be gone. It’s about what the University stands for.

Miles didn’t pull the trigger. So now you’ll need to prove that Miller knew that Miles was going to hand it to the 3rd party and that the 3rd party was going to commit a crime with the gun.

I’ve been saying this same thing on this board for two days now and I’ve been downvoted for it. It’s just the way things are from a legal/criminal standpoint, but some don’t want to hear it.
I don’t practice much criminal law, but even I know that the DA isn’t going to charge someone for a crime that they don’t feel they can satisfy the elements of. That’s basic legal knowledge.

They’ve said Miller was cooperative in handing over his phone for analysis, and I’m assuming they have Miles’ from a criminal warrant.

Criminal or not, not the best idea to bring your drunk friends a weapon.

I feel like you’re willfully ignoring the point. But as someone with morals, I’m not bringing a gun to my drunk friend in the middle of the night because they request it. It’s a recipe for a disaster. Without Miller’s involvement, she was never shot and Miles isn’t in jail. Which at the very least has taken a loose cannon from the streets.

Not illegal though.
Intent will be basically impossible to prove and Miller didn't seem to try to cover anything up based on all we've heard so far.
I think he's in a good spot legally. He's lucky he wasn't hurt himself as it seems he was in his car when it was shot up.
