It seems like Auburn is being cautious and many other schools are just planning on breaking the rules that they just agreed to.

The rule is intended to prevent schools from using fake NIL deals to circumvent the salary cap. However, the likelihood of this is highly dependent on whether the Deloitte-run clearinghouse will have any teeth. At least one high-profile sports lawyer has argued for athletes to refuse to disclose NIL deals to the clearinghouse. It remains to be seen how the the College Sports Commission will attempt to handle a punitive case of cap circumvention.

Yellawood offers contracts for spokesmen for the company, is that legit?
If not then, what about Offord, he signed with Oregon and the difference was some shoe deal. Nike would never offer a shoe deal to some high school kid in Alabama for six figures. Does Deloitte say that is null and now what you are paying him has to come from the 20 mil?
How the heck can you get in some negotiation with a kid who is looking at two other schools and signing day is tomorrow.....do you have a friggin conference call with the other two schools, the prospect, and Deloitte so they can tell you on the spot if its a righteous offer

Basically it's is supposed to be payment for using the players name, image or likeness to bring value to an entity so your Yellawood example would be approved. Doctor Pepper commercials would be approved. A collective giving a hundred thousand to a kid to show up at Joe's bar and take pictures for an hour would not be considered legit but that's what the collectives currently to.

It’s a complete shitshow much like every thing the government gets involved with. The NCAA has no teeth when it comes to the abilities of players to make money.
I expect this new NILGo thing to make it to its first court case then lose and be gone. The salary cap works in professional sports because the team owners all agree to play by those rules. In college sports about 15-20 teams could out spend all the other teams combined. Luckily as a fan of Auburn Sports we are one of those programs but there definitely needs to be a split from the NCAA and the 2-3 conferences that separate need to make up their own rules and if you break it you’re kicked out. That’s the only solution I can see going forward.

What about the Nike example? Its a legitimate company, but no sane person would believe Nike would spend that amount of money on an unknown kid out of high school in Alabama, its not like Kobe Bryant signing with the Lakers.
If that flies, I can simply set up an NGO to rescue dogs, make Deuce Knight a spokesperson and pay him.

All the settlement did is put a 20 million dollar ante into the pot and let it escalate from there.
Pretty soon the contracts will be so lucrative the NFL will complain no one wants to graduate when they are in their eight year of covid, medical waivers

I've been trying to piece this stuff together after not having paid much attention...
Is the challenge on the new NIL/CSC stuff that most of the NIL stuff in recent years would count toward the rev cap because most of the NIL stuff was "fluff" rather than legit payment for promotions/likeness?
As in, say JA is going to get 500k from Byrons in 2025 for doing 3 small time small town commercials, and via CSC's fair market value scrutiny, that wouldn't be allowed as an exception to the rev sharing cap going forward?
And as applied to Auburn, our conservative approach is essentially only to offer up pieces of rev sharing right now instead of that + third party NIL pledges that are about to become far more difficult under the new landscape?

I have no idea how a group of people are going to determine “fair market value” because that is always subjective.
But to give an example of a true NIL payment for a professional athlete. The UFC’s Mighty Mouse Johnson has been in every EA sports UFC video game even on the cover of one version of it. He told his earnings from what EA paid him each year and the grand total was $72,500 for all years. Most years was only $10k. So if world know professional UFC champion and at one point considered the pound for pound greatest in the world only gets that amount for being in a video game which definitely uses his name image and likeness how is Joe Blow left tackle at Cracker Jack state gonna get an endorsement for 700k for local ford dealership?

Nah. It works in the NFL because they have a draft. They have no incentive to pay under the table since they can't just recruit whoever they want.

It feels like all this rigmarole is only settled ultimately by a CBA. I wish they cut the shite, take the top 64 teams, put them in 4 leagues (or divisions), 16 teams each, start some kind of a draft of HS kids and become like the NFL. It’s the only way any of this gets settled.
