Bielema wants to keep that money and receive the remaining $7.6 million while working as a defensive line coach for the New England Patriots for $150,000, far below the market value of an assistant in the NFL.

That is the maximum he’s allowed to make (it was previously reported as $50,000) without it coming out of his monthly check of $320,833.33 that was being paid until this year.

Late last year Scott Varady, president of the Razorback Foundation and an attorney himself (and a Little Rock Catholic High graduate), decided the agreement with Bielema had been breached.

Varady decided to fight for the Razorback Foundation and its members.

Before going any further, here are the players besides Bielema and the Foundation.

Bielema’s agent, Neil Cornrich, and it should be noted he also is Patriots Coach Bill Belichick’s agent.

Bielema is represented by the law firm of McGuireWoods, which has 917 partners, associates and various other legal minds. They have 21 offices covering all the major cities in the U.S. as well as London and Shanghai.

In August, they added top-shelf attorney Tom Mars, who has offices in Atlanta and Rogers. Mars is the hottest name in college athletics right now.

It appears R. Craig Woods, the Woods whose name is on the firm, is representing Bielema.

Maybe they should be called the Goliath.

The Foundation has hired Marshall Ney from the Rogers office of Friday, Eldredge and Clark.

The Friday firm has 89 attorneys and three offices, all in Arkansas.

It is hard to call them the David vs. Goliath because they have some of the sharpest legal minds in the country, but they are physically outmanned 10 to 1.

However, if this disagreement ever goes to court it will be in Washington County.

Anyway, those are the players.

In January, Bielema received an email from Ney, of the Friday firm, informing the former Arkansas coach he had breached the agreement in which he was required to:

• Diligently seek and obtain other employment of the same or similar nature;

• Provide a written summary to the Razorback Foundation of his efforts to find other employment twice a year;

• Notify the Foundation in writing of other employment obtained and income received; and

• Use his best efforts to maximize earning potential with any new employer.

It seems the Foundation and Ney felt Bielema failed all four of those requirements and therefore breached the agreement.

Bielema is a likable guy, but his monthly payments were about nine times the average income in Arkansas for a year, and nowhere did the agreement say he could make a career change.

Bielema’s lawyer answered with a laundry list of ways Bielema had searched for head coaching jobs, but when studied there were several emails between Bielema and Cornrich about various subjects.

There was a hint about Arizona, who was already looking at Kevin Sumlin. There were several media speculations that Bielema was in line for a job, but there were no quotes from him.

Meanwhile, Bielema was an unpaid volunteer for the Patriots for an entire year, and of the 10 Power 5 openings, he sought none.

He was quoted last year as saying he may not return to the college ranks.

Bielema seems happy in the NFL, and he deserves happiness. Take the $4.2 million and stay happy.

If this gets taken to court, he could lose it all.

Case would be in Wash. County circuit Court. He will lose and then he will appeal it. Court of appeals will likely affirm lower ruling, unless there is some kind of firmly provable evidence that he tried to get a college HC job.

Him openly admitting he may not ever go back to college is a giant hit against him.

If appeals court rules in favor of plaintiff, Bert may again appeal the decision to the state Supreme Court.

If it's pretty open and shut, they won't even take the case and just throw it back to the appeals decision.

In all Bert could be out hundreds of thousands of dollars in legal fees and have probably wasted 2-4 years in court.

Wally has a good line at the end:

Bielema is a likeable guy? In what universe? I've hated the mouthy fat frick since the day he was first announced. There isn't one single thing about him to admire or respect or like. He's lazy. He's obnoxious. He's a drunk. Even his so called "hot wife" is nothing more than a gold digger who was trolling Vegas high rollers. Whats likeable about him? People act like Petrino was morally bankrupt !!! Compared to this fat frick Bobby is a Saint.

It sounds pretty personal, I doubt they would be going to this extreme if Chad was winning 10+ games, scoring 40+ points a game and selling out DWRRS.

It wasn't that long ago they sat idly by as Florida paid Pelphrey the maximum allowed in his contract (well below average SEC assistant pay) all the while Donovan trashed Arkansas for firing Pel every chance he had.

Bert in the NFL only affects Arkansas financially, Pel was not only financially but competing directly against Arkansas. They should have fired him for cause and used his medication dependency as the reason why.

The AD doesn't handle the payments of the buyouts.

Nutt (who left with his money, not the RFs), Heath, and Anderson all landed jobs that negated the buyouts.

Its interesting that Arkansas is going to be the first to challenge all of this now, after paying out Pel who was doing basically the same thing a few years ago.

So I would have to say Bert pissed off a few of the wrong people or the University is trying to set a precedent for when they tell Morris to go join his wife down in Dallas.

I'm all in favor of saving and/or recuperating money, especially when it was earmarked for someone who burned our football program to the ground.

I'm just concerned about the optics — especially how they're perceived by coaching candidates — of litigating a former coach's buyout while simultaneously firing another after 2 seasons.

Either way, Bert and Morris can both eat shite.

Morris had better be real worried right now. Looks to me the main reason the RF is going to fight is so they have enough money to send Chert packing. I don't see Uncle Jerry kicking in on this one.

Most coaches that get fired try again, and harder. Bert went to be a position coach at 1/12 his previous salary.

The optics currently are that you can use us for a nice retirement package - that we are a bunch of suckers who will roll over and let you STEAL from us.

I'd rather us go down fighting and tell those frickers that if you suck here you ain't getting a dime. Oh no ----- no good coach is going to come here - guess what> they ain't coming right now anyways. Set the standard and reverse the dumbass trend of ridiculous buyouts.

In regards to the media - they are always going to find ways to shite on the Razorbacks. Look how the media skewered us when we hired Petrino. Go back and look at how the media all favored Duke in the national championship because they were "smarter" than us. Go back to the multiple times when the announcer jumped the gun an said "it's good" or "Boom got it" (basketball vs. UNC and Michigan). frick everybody else.

Look at how plenty of our transfers out (see baseball) get instant eligibility but we can't get the same for any of our sports. We need to win and when the NCAA comes after us for winning we need to tell them to frick off.
