This reminds me of all those people moving out of California and NYC because of what their politics have done to their states, THEN bringing the same ideology to the next state.

I'm definitely not. What in my statement makes me a democrat? I believe a student should be able to make money for their abilities. Sounds pretty capitalistic.

Yeah not seeing how this is a political issue. Its common sense. If an adult's talents are worth money, then they should be able to capitalize, ESPECIALLY when there is such a short shelf life for football players. Very capitalistic IMO.

Is the NIL like the wild west right now, and in need of some kind of reform? Yes.

The problem is that the NCAA is on very, very thin ice right now as far as antitrust law goes. The SCOTUS is itching to blow it all up. Any efforts to restrict NIL will get challenged and run the risk of bringing the NCAA down as an organization. They would need to show why they are exempt from antitrust law, and that would mean legislation specifically exempting them or collective bargaining with an athletes union. Neither of those things are likely to happen, so instead we're just left with this fricked up pro sports-lite system without contracts, salary caps, or tampering rules that essentially makes every player a free agent every year. It's a slow death, but NIL will eventually kill college sports. That's just the unfortunate reality.

Remember SCOTUS has yet to rule on NIL. Basically the NCAA has now backed off of it which is forcing the conference/programs to deal with it. SCOTUS has made it very clear in their opinions they will not allow the NCAA to prevent if they try.

For a union to happen the athletes would have to be declared as employees or they would not be allowed to organize at all under federal law. But the issue rises with some democrats along with the NLRB wanting athletes to be classified as employees of the university. Their argument would allow the forming of unions, employee benefits, and other rights granted to employees. If that happens and they become employees they will no longer be considered amateurs. At that point just another pro league as they would be hired in a sense to perform on the field with no need to attend class.

The universities do not want that so in essence the NCAA not taking a position currently they are just waiting because the powers to be in the sport, conferences, are going to have step in and regulate to keep them student athletes/amateurs while also figuring out a way to structure NIL to be transparent and refine it. They will end up needing the NCAA at some point.

I heard one rumor to start is ending free transfers. NIL is causing a lot of tampering, especially with no sit out rule, and to many players are going to be left basically the NCAA's version undrafted and no place to play.

This is why I say a union and collective bargaining is unlikely to happen. It's how MLB has managed to skirt antitrust law, but it comes with a whole host of issues that would ultimately make the whole situation worse.

I think this is probably the most effective solution. It's basically a bandaid on a cut that needs stitches, but it would at least end this ridiculous annual free agency setup that has been created.
