Just got done listening to their show from today and they all said they were going to take clay to task for his comments. We shall see...

He sued for those amounts. They reached a settlement. You don't settle for the amount he originally sued for...you just don't. From the American Trial lawyers link you posted:

That settlement was $25,000. Thousand. Not million. Not hundreds of millions. He settled with Washington Post (and likely CNN) for $25,000. How do we know that? A lawyer on twitter posted a thread about the case and explained what a "nuisance fee" was and that usually those settlements were $25,000. A CNN reporter retweeted that and Sandman's lawyer (L. Lin Wood) lost his mind and threatened to sue CNN for violating the settlement agreement. Yes...he claimed a CNN employee retweeting a lawyer talking about the Washington Post's settlement violated the CNN settlement. By claiming that he essentially admitted the claim was true and it would mean CNN and WaPo had the same settlement. Spoiler alert: he didn't sue CNN and Sandman fired him as his lawyer too.

That just isn't true. He sued them for $250 million. The settlement amount was and is undisclosed. The case was also initially dismissed, but the dismissal was overturned on appeal on a pretty narrow issue. Odds are he got something like half the amount of money WaPo's attorneys estimated it would cost to win the case at trial.

CNN did the same. Those were the only cases to survive motions to dismiss, so it makes sense that they'd pay him to go away instead of having to deal with motions, discovery, and trial. The rest of his cases were tossed at the motion to dismiss stage. That kid probably got like $75,000 from a couple of insurance carriers after teeing up something like $1 billion in damages claims and then turned $30,000 of it over to his lawyers. Good for him I guess, but he lost those cases badly.

Winning a defamation lawsuit is very difficult, especially when the media is involved. However, I think we can all agree that Clay Travis and his media company are being very dishonest when they say in their headline that the gun belonged to Miller. Even the most basic of google searches would prove that to be incorrect.

I know we are getting into the weeds here but I think there probably is a distinction also between the relatively anonymous Sandmann and Brandon Miller. I don't know if Miller would be considered a public figure but I'd wager a pretty good probability. That matters when you're trying to sue a media outlet.

Miller is future top 5 pick in the NBA with millions of dollars and his reputation hanging in the balance. He's absolutely a public figure. His NIL value is the highest of any current UA athlete, football included.

And as such, he would have a much greater burden to overcome in any lawsuit.

I just download their segments I want to hear. One time, I accidentally downloaded (and immediately deleted) a Travis interview. I felt horrible.

They won’t do crap. They’ll give him a little pushback and then it will be right back to a tickle fight.

Their defense of having him on the show the other day was pathetic. Screw those guys.
