First one will be Julio, Eddie Jackson, Ryan Anderson and Saban talking football in the barber shop.

Watched the preview, I laughed when Saban chimed in. Julio was giving this sage advice with feeling in his tone.... Then Saban chimes in with a monotone joke, complete mismatch in energy from Julio. I chucked at the joke, but it seemed out of place

Definitely a cool recruiting tool/video series though.

With a full time job AND taking on classes. I don't know how you have time to post on the board. So, I took the privilege of creating a gif for you. I hope this saves time for you.

Lebron's "The Shop" name and productions can be copyrighted, but that doesn't prohibit others from producing something similar. Lots of TV shows, movies, music, etc. are produced that are just as similar to others as Bama's is to Lebron's.

Bama probably ensures it doesn't infringe on others' copyrights, trademarks, patents, etc. Bama can also (and maybe does) copyright its "Shop Talk" name and episodes, but other universities could still do their own knock off.

Unless people talking about sports at a barber shop was invented by Lebron, he has no case. Besides, Bama's "Shop Talk" aguably targets a different audience than "The Shop" and won't adversly impact it. But his whining is creating publicity for "The Shop" and for "Shop Talk" too.

ETA: I wonder if UA will have to charge athletes for Bama Cuts' services or offer free hair cuts for all students in order to comply with NCAA rules against special benefits. The Barn, Fulmer and Mullen have probably requested the NCAA put a stop to UA's heinous barber shop shennanigans and issue severe punishment.

The hair cuts aren't "free". Also, I think every student has to have access to the shop in some capacity

That's not what they sent. It was an attempt to inform Bama of Lebron's claim of infringement and discuss possible remedies. Pretty sure you have to "enforce" IP claims to maintain their integrity

These comments do not appear to be true based on the American Bar Association's published paper on the topic, it would appear Lebron James has a legitimate claim assuming he has done the proper IP background

From what the paper says, it isn't a slam dunk for Lebron, but assuming his team did their job right they probably have a very good case

They almost for sure charge based on the following quote from an article on Clemson's website

"Haircuts are a bargain at $10 a pop, and players are responsible for paying, lest compliance come calling."

quote:

Considering this wasn't a cease & desist, this is probably the main reason Lebron's team sent the letter in addition to staking claim to his potential IP

Perhaps the letter doesn't include the words "cease" or "desist" (I haven't seen a copy of the letter), but according to ESPN it does "invite" conversation as an alternative to their threat to promptly pursue legal proceedings against UA. Sort of splitting hairs, iyam.
quote:

"Your continued exploitation of 'Shop Talk' infringes 'UNINTERRUPTED's' copyright, trademark rights and other valuable intellectual property rights in 'The Shop' and significantly damages 'UNINTERRUPTED's' commercial prospects for 'The Shop,'" the letter reads, in part. The letter goes on to invite a conversation with Alabama before "rushing into legal proceedings."

'The Shop' is the trademarked name. 'Shop Talk' is not use of that trademarked name. It will be very difficult, at best, to ever prove that UA's "continued exploitation of 'Shop Talk' infringes copyright, trademark and other valuable intellectual property rights in 'The Shop' and significantly damages commercial prospects for 'The Shop.'" It's conceivable that 'Shop Talk' may actually increase popularity of, and "commercial prospects for, 'The Shop.'" Lebron and his lawyers may actually be the ones who end up damaging 'The Shop.' If Bama's attorneys handle the "conversation" well, Lebron and his attorneys may wise up and cease the saber rattling.

10 Cases of ‘Family Guy’ Ripping Off ‘The Simpsons’

Do 'Family Guy' and 'The Simpsons' cause damages to each other or do they mutually benefit each other's popularity?

Considering how common cease and desist letters are, it is a huge deal they opted for an alternative

Did you even read the paper I linked?

What you are saying would suggest you haven't as it is incongruent with the American Bar Associations opinion

quote:

Do 'Family Guy' and 'The Simpsons' cause damages to each other or do they mutually benefit each other's popularity?

First, these are both fox broadcasting properties so they aren't likely to sue themselves

Second, the ABA paper you clearly didn't read goes into what parts of TV Show formats you considered IP
