Memphis is reportedly facing four Level I and two Level II NCAA violations stemming from an 18-month investigation into the Tigers' men's basketball program.
The Daily Memphian obtained the notice of allegations and an amended notice of allegations from the Independent Accountability Resolution Process investigation. An infractions case involving former Memphis center James Wiseman was the first case accepted by the IARP in the spring of 2020.
Good for LSU hitting the ground running. Will his show cause hearing be before or after he joins LSU?

There is nothing in Nico’s contract that directly ties him to playing for Tennessee. So good luck penalizing a school for using it as a recruiting tool as everyone is following the same practice.

Again, this is your misconceptions, not the reality. You are assuming that people are going to be able to force the NCAA into doing nothing because "everyone is doing it". Well, that's also what LSU fans were claiming. You can say "everyone is doing it", but the reality is if everyone is doing it - it's the ones that don't do it right that are going to get slapped.
Here are some of the rules that might be getting broken in that case.
1. The NIL contracts are supposed to be signed after the they are on campus, and the duration of them is not allowed to extend beyond their college career.
2. Contracts must be approved before being signed. You can't just up and give the money away, you have to show market value. So social appearances and all that have to match the value. For someone like that LSU girl who has a million followers, that's really easy. For other players, not so much. If a business would normally pay a guy $5k for such a thing, and suddenly they are wanting to pay $150k for this player, that's probably going to be an issue.
3. The places where there might be "loopholes" is with state laws, and I don't know how that's going to work. But the schools themselves are bound to their state laws. I'm not a lawyer and I don't know what all the laws are by state, but depending on the law in Tennessee, it could be an issue there, but not elsewhere.
We'll see. But my bet is the NCAA throws some punches here and there even if it's at minimum to keep the illusion that it's not being used for recruiting directly.

Of course. It’s still the NCAA. Let’s say there’s a big booster that owns a car dealership. That booster still can’t say, “I’ll give you $50k to attend and star for my alma mater.” That’s still illegal. There are still going to be the same type of recruiting restrictions that have resulted in infractions and punishments in the past.

Yep. And they’re not even really loopholes, even though they might feel like it because of how we’ve been conditioned to think about the NCAA and “amateurism.” They’re just “legal ways to pay athletes for their services” now. In the above example, an athlete who signs with a school could immediately start a series of personal appearances and endorsements over his/her first year at the school and get paid a total of $50k. Probably couldn’t get away with $50K for one autograph signing — that’s not market value — but if it’s 10 appearances/promotions at $5,000 each? That’s all fine now, because it’s a player using his/her “celebrity” at a school to make money, not using his/her promise as a recruit to get encouragement money.
