The reason is he has not been declared ineligible and until then the NCAA gives the school their choice to rule him ineligible or play him at their own discretion and take the bad with the good later. So, the school figures through what they have found on their own is they have decided to play him. The NCAA does not make the decision for the school it is up to the school to decide not to play him and up to this point they have made their decision.
