Also, the DA asked to not give the death penalty, but the judge could have ignored her request and done it anyway.

Nope.
Had to be declared before the trial and, had they declared that they were seeking the death penalty, his lawyers would have offered a guilty plea with a guarantee of life rather than death. To which that would have saved the family from having to see the savage brutal evidence admitted into the trial ... not to mention the costs involved.
Instead, they decided to take it to a bench trial without seeking the death penalty because the Soros prosecutor wanted to give them grounds for an aquital on the outside chance that the DNA evidence was attributable to the defendant's brother.
