A&M made their position clear. So if the kid wants to play he is free to transfer.

I think the biggest difference is that A&M seems to have signed an actual former pro and then let him sit on the roster for months.
LSU seems to have just talked about it.

Oh silly you… you forgot that A&M isn’t battling the SEC over it, once the SEC announced a rule this week.
Is LSU indicating that they might be going to battle…

Honestly, if I was LSU I hope they don't try to go through with following court order. If LSU hasn't signed the players and the players sue LSU that goes right up to the SEC to pay the damages.
If LSU signed the players but kicks them off, LSU gets sued and the SEC still pays a portion of the damages because of what they impose on their members.
The SEC is tied to this through and through.

Yes, it’s very clear that LSU is not being proactive. We can all see that.

Honestly, I think LSU has played this pretty well.
They have stated they are on the position of the court and the law.
They abstained from voting on the penalties the SEC can levy, which creates a degree of separation for any anti-trust laswsuits brought. I think the 15-0 "unified vote" is being misinterpreted and the trouble it could cause for other members.
LSU took the PR hit up front, but long term might play to their benefit.

Only on penalties. Abstaining from casting a vote is quite literally, not choosing sides.

If this all goes down the route of being heard in federal court for anti-trust violations, LSU being able to say we didn't vote for that is very smart.
If a judge rules 15 SEC members (except LSU) voted for something against the sherman anti trust act, LSU looks brilliant

Why's it shortsighted? There was no negative to abstaining. It's a neutral-win proposition.

How?
Nothing bad can happen from abstaining from a vote on potential penalties. This is never going to be LSU vs. SEC.
