The other person wasn't exactly innocent in that whole situation either. Not saying he deserved what he got but when you talk trash and intentionally attempt to piss someone off don't be surprised if it happens. If Smith had used a deadly weapon or any weapon he'd have been kicked off the team, in his case he lost his temper and got into a fight, not saying it is ok but it is something many can relate to and feel a second chance is warranted. Where as robbing a house with a weapon is not something most can relate to.
This is a case where the evidence is overwhelming and the players are likely going to plead guilty so they can get reduced punishment. Also Chizik spoke with the key people involved in this issue and made the decision from there.

"Without an answer, the suit was filed in time to comply with statues of limitation on some of the claims (two years from the date of the incident)." Armstrong declined to elaborate on the complaint and said the suit was filed to hold McClain "accountable for his own actions." "It is not our intent to contribute to a circus atmosphere, and we hope Mr. McClain will likewise not seek to try this dispute in the media," Armstrong wrote. I think that was the guy that was yelling at McClain and screaming Ni___r at him. Waited to file suit after he signed an NFL contract. I don't recall him getting a felony arrest out of it.
eta - having said that. It was a dumb decision to beat the guy down. Shoulda realized he was being baited. Goes back to earlier arguments in being not mature enough to handle a situation.

There are strict standards and consequences for what you claim in civil proceedings. I'm not saying everything contained in a pleading or testimony is factual but it definitely has a better track record for veracity than internet message boards.
