Because of innocence, until proven guilty. You saw a guy rubbing himself on someone's head. It doesn't prove it was assault. Do you know for a fact that they didn't know each other? Do you know for a fact they didn't stage this before the video was taken? The state has to prove there was a victim first, and the only way to do that, is to have the victim testify. And then the defense has a right to depose and question him in the course of a trial.

Someone needs to come forward with info about the assault and battery that occurred in the Superdome on the 9th. I know there's a video of that floating around...it's big on YouTube.
I'm sure LSUpimp implores any good citizen with info to come forward and help the NO DA prosecute this dastardly act.

Video = evidence
Evidence requires a foundation. You can't just introduce a videotape without laying a foundation. Testimony as to those depicted on the tape is a neccesary component.
Oh, and that damn pesky Confrontation Clause comes into play sometimes..

Both parties will be fine after a couple of years.

His attorney saying something is not an "admission" and can't be introduced against Captain Ballsack in a court of law.

I don't know why this is such a hard concept for you to grasp. There was a viral video of the guy committing sexual assault. The media blew it out of proportion and now NOPD has no option but to prosecute.

I see no reason why he wouldn't testify. I would testify in a second, nothing to be ashamed of. He was sexually assaulted completely against his will.

I know a ton of folks who would have played it the same way. You're not going to take it to trial, so you don't have to worry about poisoning the jury pool...and your only real play is to put enough out there to squeeze a little more juice out of the DA for a better deal.

Exactly. Why not wait until the DA has made a negative decision for your client before releasing this statement? It seems to me that these two attorneys want to make a name for themselves, and they are doing their client a disservice in the process.

Yep. I am posting support for the actions of his attorneys because if the guy was in my office...I'd do the same thing. They have one play. Sell it to the media and get a deal.
Oh, and all the folks talking about the DA and NOPD getting pissed off...they are big boys. They know how the game is played.
