Actually I think in Arkansas if they can prove alcohol is in your system and you are underage, you are then "a minor in possession" of alcohol. I have no license right now thanks to Arkansas's harsh view on alcohol. Last time a cop in Louisiana saw me drinking, he specifically said "drink one for me, I'm out" no lie

Sweet Christ. Everyone went full retard. While the law may provide that a party under 21 may drink, it does not allow overconsumption. If a 19yr old is passed out drunk, and the folks are there..no biggie?

Alright, bottom line on this dumb shite. The case isn't going to trial. The attorneys are putting things out there that will put pressure on the ADA to give a better offer. End of story.

I'm pretty sure any minor can consume alcohol if they're with their guardian in LA. I remember watching a show on MTV about that family in Port Allen, and they had their 12 year old's putting down beer. They even made a reference to how it was legal in LA for minors to drink in the presence of their guardians

I just want to know why you think that press release will pressure the DA into giving a better deal. You keep alluding to this, yet I don't see anything in it that makes the tea bagger look any better with regard to public perception. What exactly do you see besides bullshite deflections?

Man, you never know what is going on. The dude's lawyers and the DA may be good friends. I know a lot of defense attorneys here in my local hometown who are good buddies with the DA. Im sure there are agreements made all of the time.
There is an attorney in Huntsville that handles DUI cases. I havent ever used him because I have never gotten a DUI. People have told me if you got the money, he will get the charges dropped. Stuff like that happens all over every day even though we may never hear a word about it.

Because DA's use reason, free from passion, unlike college football fans.
Bottom line. People commit crimes. They meet all the elements of a criminal statute. The DA takes into consideration facts outside the scope of the statute. Happens everyday.

They make a hell of a good point; Mr. Downing is still a dumbass though. I mean what an immature thing for a grownass man with a kid to do. Not sure if he should have to basically pay with his life for it though.

I sold my soul a long time ago on a matter much more terrible than a teabagin'. People are going to do dumb things. Attorneys are going to grandstand, and DA's are going to cave on shite. Welcome to the real worldd. The guy who shot someone? He is going to serve 4 years because the prisons are overcrowded..the teabagger? He is going to get a deal because at the end of the day..shite isn't that big of a deal.

In Arkansas, a minor can drink at home under parental or guardian supervision. At least it used to be that way. The 18 year old kid at Krystal could be arrested for public intoxication in Arkansas, as with most places, but not post hoc.

That seems like such a fuzzy law. What if I'm drinking at home, with parents present, but asleep? That pretty much sums up my early years.

Sorry about that. It is 2, and I'm up because the gawddamn state of Alabama changed the DUI laws back in Sept. I'm up and trying to find any excuse to put off working. Can't sleep, have to work, and folks are going full retard. INTERNET SERIOUS BIZNESSSSSS!!!1!11!
