That batter didn’t flail lol. He clearly moved backwards in an attempt to get hit. If the pitcher doesn’t throw it within the space that is the batter it shouldn’t be a HBP. Obviously you disagree that’s fine

And if he can’t then he deserves a ball. If he hits the batter it’s a HBP. If the batter hits the ball, well idk what it should be but it shouldn’t be a free base
