Is LSU still planning to create the private investment entity?

Right now, LSU’s best defense against the SEC seems to be the legal protection afforded to a government entity against a private entity.
If LSU spins off a private entity that receives and invests the TV revenue, wouldn’t that open up more options for the SEC to take action down the road?

At what point do you all accept that the SEC and NCAA were told to sit down and be quiet once again?

The SEC won’t take action on schools based on rules that clearly violate antitrust laws.

That’s exactly my point. I think there is a good chance LSU is shielded as a member/govt entity.
But if LSU creates an explicitly private entity for their TV revenue (the idea that was floated a couple weeks ago) doesn’t that change things? If the SEC withholds revenue, they are no longer withholding from a member institution but a private investment company. Sure there would still be lawsuits, but much more favorable for the SEC.
