Just because he didn't break the law, doesn't mean he didn't do anything wrong.

It sounds like there were plenty of contextual clues that should have led Miller to realize that taking Miles the gun could result in someone getting hurt or killed.

In order to do so legally, he would have had to either have had a pistol permit or have had the gun unloaded and out of reach, both of which could very well be true.

But if he was smart enough to know exactly what kind of trouble possessing that gun illegally could get him in and took steps to store and transport it correctly, after midnight, to the strip, to his drunk teammate, then he sure as hell should have been smart enough to put 2 and 2 together and stayed the frick home.

I don't believe this is the case now. Alabama went permitless at the first of the year.

Unless new evidence is discovered, he will almost certainly not be charged. Whether that is the correct decision and whether there was any outside assistance in reaching that decision should be investigated. The DA has staked its position that it didn’t believe it has any evidence of intent and it isn’t going to reverse course at this point.
