No it doesnt, and no he isnt.

Tennessee has the same (or similar) agency laws as every other state, and if Currie and/or UT held himself out as having authority to bind the university and if Schiano reasonably believed that Currie had the authority to bind the university then the university is bound by the contract.

The question is going to be whether Schiano, who is familiar with employment contracts at public universities, reasonably believed that Currie alone could bind the University. I don’t know the answer to that.

You have a signed offer (by someone at the university empowered to make the offer and under the terms the university is putting forth as acceptable to them) and signed acceptance.

I would love to be Schiano's lawyer for this.

is it that simple regarding Currie signing authority

how Schiano know that isn't reasonable to assume Currie could sign on his own.

So you could look at him and laugh? The contract clearly has a finite number of required signatures from specific people to be valid. That number was not satisfied. So no, I assure you, you would NOT love to be his lawyer.

However, it does speak volumes that you would "love to" assist a known aider and abettor of a known child molester.

Penn States Trustee cleared Greg of any and all wrong doing.

The courts will view it as any of the names printed were able to sign the MOU and make it binding.

Almost as good as:

School says it wasn't fully signed, so Schiano isn't owed anything.

I agree AlaCowboy, as it reads unless there is cause...and there was not...there was a signature from a duly authorized hiring person from the U of Tennessee and it was signed by Coach Schiano. That would make it an official document at that point, making it 75% payable.

Thank you for posting this DR. This is very insightful for somebody like me that never has anything to do with contracts.

I'm guessing you don't know anything about contract law.

Offer and acceptance, look it up. This is an easy case to win.

"But Penn State" isn't going to win any points with a judge.

Best bet for the stinking vols is to go to arbitration, assuming Schiano's lawyers will agree to it.

I wouldn't.
