A court can absolutely dictate a private business' rules or qualifications to be employed by them if there's a violation of federal law.
As I posted, the original court case revolved around one issue: Did antitrust law apply or did labor law apply.
If antitrust law applied, as the original court ruled, this rule could absolutely be tossed out, period. If labor law applied, as the appellate court ruled, the rule was legal and could be tossed out.
But to say there's absolutely no scenario by which a court could toss it out is just wrong.

He also said Jeremiah Smiths team has hired a lawyer to challenge the 3 year rule to go to the NFL and he expects that to go away after he wins his case.
If this means we get a bunch a future engineers and doctors (ya know actual student athletes) out there running 4.9 40s duking it out under the lights on Saturdays, I’d probably be more entertained than I am now.
At least it would go back to players actually giving a shite about the university.

This is a dumb take by that lawyer. Its an NFL rule and even the clown show courts cant force that

People were filling stadiums in the 20s to watch glorified frat boys play football. Its never been about the athleticism of the players....or thousands would go to track meets

The government has no business making rules for private entities. If the NFL wants the 3 year rule, it's not the governments business.
Although I think if we did away with that rule, it would be better for CFB. Let all the 5 stars declare for draft out of HS and spare the rest of us the NIL drama. But I don't want the government deciding this.

NCAA has nothing to challenge that’s a NFL rule. Honestly if we go to revenue sharing with salary cap then the NcAA can investigate and punish as they did prior to the NIL era. Why would it be worse?

Colleges should do exactly what the NFL and NBA do. Hire players with contracts that have salary caps, free agency time lines, all the restrictions a professional contract has. The Nfl and Nba do not get sued.

quote:Im sorry but this is a huge generalization. While I get your point, there are always outliers. I’ve seen freak athletes at 17 or 18. But what about positions you don’t have to be massive. Kicker, QB, RB, Flanker, WR, DB, kick returner come to mind. If teams could draft young guys they most certainly would, strictly on potential.
Well the main reason the 3 year rule has been in football is because pretty much no kid practically out of high school is physically mature enough to compete with grown arse men that are freaks of nature in the NFL. Most would find out that they needed college to develop physically before they go tussling with grown men strength.
Hershel Walker was a grown arse man at 17. I know dozens of others. You don’t think he could run the ball at 18?

Plus there is an argument to be made for their bodies to mature before they hit the pros
