The problem is it is an unconfirmed report cloaked in anonymity, so who knows if it's true or not.

Completely hypothetical, but let's say the reports are true and Desmonte got hit over the head with bottles. How would something like that play out in court if he was using self defense? Obviously too many unknowns, but could the bottle thrower get charged with murder if innocent bystanders were killed?

I think in Alabama, your life has to be in danger for you to use deadly force. I guess it's really depending on the circumstances.

I know I've been told by sheriff's deputies that even if someone is breaking in that's the case. On the other hand, I was also told to shoot as soon as you know that they are breaking in and drag them into a corner.

Wouldn't that be a felony assault charge though? A bottle can be a deadly weapon.....

Again, all hypothetical....bottles are just an unconfirmed report

If true, this changes everything. If the gunman left the scene and came back to shoot everyone, it is murder. If the football players were talking shite to the gunman's girl, started a fight, hit the gunman over the head with beer bottles, and then the gunman shot them to protect himself, it is self defense. We may have to wait for the facts to come out on this one. Either way...such a tragedy that this could not be solved with fists and instead had to involve weapons used by both sides.

Absolutely. Regardless of murder or self defense, this guy knows he is in trouble (see Zimmerman).

I'm pretty sure the guy that hit the shooter over the head with bottles wasn't an Auburn football player, FWIW. According to news report that was posted earlier, it was a friend of Pitts, and I believe they listed his name.

Is that not what everyone in here is doing? There may be a flip side to this tragedy and before we wish the wrath of god on this guy, we should first find out if in fact he was being beaten over the head with beer bottles.

You should probably wait until confirmed reports come out. You are taking various accounts from anonymous sources and piecing together a "what if this, what if that, this justifies that, that changes this" scenario.

So now we are getting reports that the shooters fired immediately after being hit by bottles as well as reports that they came back to the scene. We are also getting reports that a football players hit him with a bottle as well as that it was not a football player. This story has so many questions left that none of us can judge anyone. All we can do is pray for the families and hope that justice prevails.

Evid he didn't leave to get a gun, why did he bring a gun to a pool party? I know that isn't illegal but still why bring it?
